After Resigning, Can You Immediately Claim BPJS Ketenagakerjaan? Here's the Answer
Withdrawal of BPJS Ketenagakerjaan funds for employees who resign is governed by applicable rules. The social security claim process depends heavily on which protection program is being claimed, namely Jaminan Hari Tua (JHT) and Jaminan Kehilangan Pekerjaan (JKP).
Here is an explanation, quoting the official BPJS Ketenagakerjaan site.
If you have just resigned, can you claim JKP under BPJS Ketenagakerjaan?
Can Jaminan Kehilangan Pekerjaan be claimed if you resign? The answer is no. The reason is that JKP is designed for workers who lose their jobs due to dismissal by their employer, not because of their own choice or resignation. Its purpose is to provide financial protection for workers who have been made redundant to maintain a financial cushion while waiting for opportunities to work again.
To ensure that claimants have truly lost their job and not because of a voluntary decision, claimants must attach evidence of termination of employment (PHK) when filing the claim.
Other Exclusions under BPJS Ketenagakerjaan
Each programme within BPJS Ketenagakerjaan’s social security has its own target and purpose, including JKP. In addition to leaving work due to resignation, there are several other exclusions that may cause a JKP claim to be declined, including:
Death
Reaching retirement age
Cessation because the contract period has ended
Stopping work due to total permanent disability
Not meeting the minimum contributions (at least 12 months registered in the 24 months preceding the PHK)
PHK carried out because the worker committed serious misconduct and has been legally proven in court
In addition to the exclusions mentioned, JKP claims can also encounter processing difficulties if they are past the deadline, namely a maximum of three months after the company’s PHK decision. Therefore, to prevent this, ensure you apply for the claim promptly after receiving the PHK decision.
JHT BPJS Ketenagakerjaan Claim Rules after Resigning
For those who resign, you can still apply for BPJS Ketenagakerjaan’s Jaminan Hari Tua (JHT). However, there are several requirements that must be satisfied for the claim to be processed, one of which is that you must have passed a one-month waiting period from the resignation date.
After this waiting period, you can apply for a JHT claim if you have not yet returned to work elsewhere. Or, because you have not had the opportunity to work again, or because you intend to start your own business.
If you have met these requirements, you simply need to prepare all the documents required to apply for the claim. If you are an Indonesian citizen (WNI) and the total balance to be disbursed is a maximum of Rp10,000,000, you can apply online via the JMO app.
For those who do not meet the two requirements above, you can prepare all required documents and make a claim directly to the nearest BPJS Ketenagakerjaan office.
So what if during the waiting period you do get the opportunity to return to work? If this happens, you must transfer your employment location data from the old company to the new one. Do not worry about the difficulty, as the process will be assisted by the new employer.
