The advocacy team for Democracy visited Bareskrim Polri to report the acid attack on KontraS activist Andrie Yunus on Wednesday (8/4). The report urges the investigation of the case through the general courts using charges of premeditated attempted murder and terrorism offences.

This legal action is in response to the prior handover of evidence by Polda Metro Jaya to Puspom TNI. The advocacy team asserts that the victim’s right to report to the general courts must be accommodated by the police.

Representative of the Advocacy Team and KontraS Coordinator, Dimas Bagus Arya, explained that the report refers to Article 459 of the Criminal Code. “The report involves Article 459 of the Criminal Code regarding premeditated attempted murder,” Dimas stated.

In addition to the premeditated murder charge, the legal team has included the construction of terrorism offences. Dimas noted that this is a follow-up to President Prabowo Subianto’s earlier statement condemning the attack on Andrie as an act of terror.

“And in response to what Mr Prabowo said that the action is part of terrorism, we are also using the construction of terrorism criminal charges,” he emphasised.

Dimas added that the core of this reporting is to ensure that the acid attack case is processed through a Type B report at Mabes Polri so that its handling is more transparent and can be widely monitored by the public.

Associate Lawyer at AMAR Law Firm & Public Interest Law Office, Airlangga Julio, revealed that based on the legal team’s identification, there are at least 16 individuals suspected of being involved in the action.

He considers the perpetrators as civilians because there is no official information regarding their status.

“The 16 perpetrators are, in our minds, civilians to date, because there is no clear information from Puspom TNI or Polda Metro Jaya regarding the status of those perpetrators,” Airlangga said.

He confirmed that the report specifically includes charges of premeditated attempted murder juncto Article 17 and Article 20 of the Criminal Code, as well as terrorism charges. “Here, we specifically want to report the terrorism offence to Bareskrim Mabes Polri,” he clarified.

Public lawyer at LBH Jakarta, Daniel Winarta, stated that the right of citizens to report is strictly regulated in the Perkapolri on human rights standards and Perkaba Reskrim.

“Everyone may make a police report and it is regulated in the Perkapolri on human rights standards, also Perkaba Reskrim that the police must not refuse a police report,” Daniel emphasised.
