The alleged case of false imprisonment and abuse committed by Taufik Hidayat against his girlfriend, YTR, has drawn significant public attention. Many people have been outraged after learning the victim allegedly suffered years of torture, resulting in severe injuries, permanent disability, and deep trauma. Amidst the widespread discussion, comparisons have emerged with the murder case of Ade Sara Angeline Suroto, which shocked Indonesia several years ago. In that case, two perpetrators were ultimately sentenced to life imprisonment. So, if the killers of Ade Sara could receive a life sentence, does Taufik Hidayat also face the potential for a similar punishment?

The Ade Sara case became one of the most high-profile criminal cases in 2014. The university student died after being murdered by her ex-boyfriend, Imam Al Hafitd, and his accomplice, Assyifa Ramadhani. At the first instance, both were sentenced to 20 years in prison by the Central Jakarta District Court. However, the Public Prosecutor filed an appeal to the Supreme Court, arguing that the sentence did not reflect the severity of the crime committed. The Supreme Court subsequently granted the prosecutor’s cassation appeal and increased the sentence to life imprisonment. The decision was based on the application of Article 340 of the Criminal Code concerning premeditated murder. This article carries the most severe penalties, ranging from the death penalty and life imprisonment to a fixed-term prison sentence.

Although both cases have captured public attention, the case ensnaring Taufik Hidayat has different legal characteristics from the Ade Sara case. In the matter currently being handled by the West Java Regional Police, Taufik has not been charged with murder because the victim is still alive. However, investigators have named him a suspect for alleged aggravated assault. The West Java Police Chief previously stated that Taufik is charged under Article 466 of Law Number 1 of 2023 concerning the Criminal Code, which regulates the criminal act of aggravated assault. In addition, investigators are still exploring the possibility of applying several other articles, including those concerning false imprisonment or deprivation of a person’s liberty.
