There is a new standard there that did not exist in the old KUHAP. What is it? Related to the designation of suspects. It only exists in the new KUHAP. Why? It states in Article 90 that there is a process for designating suspects and that falls under coercive measures, as stated at the investigation stage,’ Taufik explained. Taufik explained that, in fact, Article 44 of the KPK Law provides for designation of suspects at the investigation stage. But because of the new provision in the new KUHAP, the KPK will apply it in line with the latest provisions. ‘We have studied it with the Legal Bureau, and also looked at the rules already set by other law enforcers, the Police (Polri), the Attorney General’s Office, and we may soon issue an internal circular (SE), regarding the implementation of the new KUHAP and the new KUHP, so that going forward, colleagues will also face it like that,’ Taufik said. ‘So the KPK will adopt our strategy of Sprindik without a suspect. Then later, as usual, how will the designation of suspects be done? After there is an investigation process. And that will apply going forward, up to 2026,’ he added. However, he explained that designation of suspects at the investigation level does not apply to undercover operations (OTT). He noted that in OTT, the process of designation of suspects or legal status must be done immediately. ‘Except for those caught red-handed, because in Article 90, clause C, specifically for those caught red-handed, the designation of suspects must be immediate, as it is already in front of our eyes,’ he concluded.
