Jakarta, VIVA – President Prabowo Subianto has issued Presidential Regulation (Perpres) Number 5 of 2026 on the Financial Entitlements and Facilities of Ad Hoc Judges, promulgated on 4 February 2026, to strengthen the quality of judicial administration in Indonesia.

According to a copy of the Perpres cited on Monday, 4 May 2026, the regulation of financial entitlements and facilities for ad hoc judges is necessary because they are officials exercising judicial authority, thus requiring integrated regulation within the legal system.

The issuance of this new regulation also aims to improve the quality of justice through support for upright, professional, and independent ad hoc judges in carrying out their duties.

Perpres Number 5 of 2026 simultaneously replaces several previous provisions related to the financial entitlements and facilities of ad hoc judges, which have undergone several changes, including regulations on honoraria for ad hoc judges.

Several main points in the Perpres include that every Ad Hoc Judge is entitled to a monthly allowance, the amount of which already includes income tax.

In addition to the allowance, the state provides facilities in the form of state housing and transportation facilities in the assignment area, health insurance and security guarantees while carrying out duties, and travel expenses (transportation and accommodation) equivalent to those of judges at the court where they are assigned.

Furthermore, the Perpres highlights the provision of an appreciation payment at the end of the term of office amounting to 2 (two) times the amount of the allowance.

For judges who do not complete their full term, the appreciation payment is given proportionally based on the length of service.

Perpres 5/2026 also regulates provisions for Ad Hoc Judges from civil servant/TNI/Police elements. Ad Hoc Judges originating from civil servants, TNI soldiers, or police members are not entitled to receive income from their original institution while receiving the allowance as Ad Hoc Judges.

Regarding discipline enforcement, the appreciation payment will not be given to Ad Hoc Judges who are dishonourably dismissed due to severe administrative sanctions or sentenced to imprisonment based on a court decision that has final legal force.

This Perpres also emphasises that Ad Hoc Judges who resign or are dismissed from their position do not receive pension rights or severance pay.
