The process of selection of chief justice from the nominees is
now completed. It is almost certain that Muladi will be chosen
the new Supreme Court's chief justice. It is still fresh in our
minds that once Muladi stated the following, "What's the use of
being a Supreme Court justice if you cannot be the chief
justice".
As a former chairman of team XI of the General Election
Committee (KPU), allow me to remind Muladi of the following:
1. When he was minister of justice, Muladi was responsible for
the issuance of Government Regulation No. 33/1999. This
government regulation was issued without prior consultation with
the KPU, a violation, therefore, of Article 84 of Law No. 3/1999.
2. Muladi then argued that his ministry had held consultations
with the representatives of the KPU, particularly those
representing the government. However, after this matter was
brought up in the plenary meeting of the KPU, it was learnt that
there had been no official request made to the KPU.
3. Deviating from the standard procedure, this government
regulation has violated the basic right of the KPU.
4. Muladi, then still minister of justice, promised to settle
this problem but unfortunately his promise has remained a
promise. We urge, therefore, that Muladi clarify this matter
openly.
