4 BAIS TNI Members Found Guilty in Andrie Yunus Case, but Only 2 Dismissed

The verdict in the acid attack case against human rights activist Andrie Yunus has resulted in different fates for the four members of the Indonesian Armed Forces’ Strategic Intelligence Agency (BAIS TNI) who sat in the defendant’s chair. Although all were declared guilty, only two defendants received an additional sentence of dismissal from military service. The other two defendants retain their status as TNI soldiers despite being sentenced to prison. The verdict was read by the Panel of Judges at Military Court II-08 Jakarta in a session held on Wednesday, 10 June 2026. The four defendants, Second Sergeant Edi Sudarko, First Lieutenant Budhi Hariyanto Widhi, Captain Nandala Dwi Prasetya, and First Lieutenant Sami Lakka, were previously charged in connection with the acid attack on Andrie Yunus. In its ruling, the panel of judges first stated that the defendants were not proven to have committed a criminal act as per the primary or subsidiary charges. However, the judges found all four were proven to have committed a criminal act as per the more subsidiary charge, namely participating in premeditated assault resulting in serious injury. The Panel of Judges declared them legally and convincingly guilty of committing the criminal act as per the more subsidiary charge. In this case, Second Sergeant Edi Sudarko received the heaviest sentence. He was sentenced to three years in prison and given an additional penalty of dismissal from military service. A similar fate befell First Lieutenant Budhi Hariyanto Widhi. The TNI officer was sentenced to two years and six months in prison and also received an additional sentence of dismissal. Meanwhile, Captain Nandala Dwi Prasetya was sentenced to two years in prison without the additional penalty of dismissal. First Lieutenant Sami Lakka was sentenced to one year and six months in prison and was also not dismissed from military service. The verdict differed from the Military Prosecutor’s demand, which had previously requested that all defendants receive the same sentence of two years and six months in prison.
