Shipping company taken to court over Rp 690m debt

JAKARTA (JP): PT Daya Radar Utama has filed a bankruptcy
petition against PT Perusahaan Pelayaran Angkutan Pertambangan
(PPAP) in the Jakarta Commercial Court for the latter's failure
to pay a service fee of Rp 689.49 million (US$ 92,000).

According to court data, Daya Radar Utama, a shipping service
company operating in North Jakarta, received several orders to
renovate barges owned by PT PPAP in 1990.

"Even though PT Daya Radar Utama has finished the renovation
work, PT PPAP has not fully paid the service fee," the document
said.

The document said that PT PPAP's total debt to the plaintiff
was Rp 557.04 million, of which it had paid only Rp 235.31
million in 1991.

"It means that the company still has a total debt worth Rp
321.72 million owing to the plaintiff," the document said.

The document said that the remaining Rp 321.71 million service
fee had grown to Rp 689.49 because of the unpaid interest and
penalties.

A court official said that the first hearing between PT Daya
Radar and PT PPAP would be held on Nov. 30.

In another development, the commercial court adjourned the
case between Bank Artamedia and PT Tamara Green Garden scheduled
for Monday to Nov. 25 because the hearing rooms were being used
for a workshop.

Some lawyers, however, complained on Monday that judges were
ignoring the punctuality principle in the country's new
bankruptcy law.

"The judge should not have adjourned the hearing because of a
workshop," one lawyer, who asked for anonymity, said.

The medium-sized Bank Artamedia, which is set to merge with
Bank Ciputra, Bank Jaya International and publicly listed Bank
Mashill early next year, took PT Tamara Green Garden to court for
the latter's failure to pay a total claim worth Rp 11.5 billion
(US$1.36 million).

According the plaintiff, Tamara Green Garden had also obtained
loans from four other banks including Bank Nomura International,
Bank Nusa International, Bank Lippo and the defunct Bank Modern
and Bank Sejahtera Bank Umum (SBU). (aly)
