Increase in Ad Hoc Judges' Allowances and Hopes for Enhanced Integrity

JAKARTA, KOMPAS.com - The allowance for ad hoc judges is confirmed to increase. This decision is outlined in Presidential Regulation (Perpres) of the Republic of Indonesia Number 5 of 2026 on the Financial Rights and Facilities of Ad Hoc Judges.

Quoted from Perpres 5/2026, an ad hoc judge is a temporary judge with expertise and experience in a specific field to examine, adjudicate, and decide on a case, whose appointment is regulated by law.

“The allowance for Ad Hoc Judges at each Court is listed in the Attachment which is an inseparable part of this Presidential Regulation,” states Article 3 paragraph (1) of Perpres 5/2026.

Quoting Article 2 of the regulation signed by President Prabowo, there are several financial rights and facilities that ad hoc judges will receive each month.

“Ad Hoc Judges are given financial rights and facilities consisting of: a. allowance; b. state housing; c. transportation facilities; d. health insurance; e. security guarantee and in carrying out their duties; f. official travel expenses, and; g. appreciation money,” states the regulation.

“In the event that state housing and transportation facilities as referred to in paragraph (1) are not yet available, Ad Hoc Judges may be given housing and transportation allowances in accordance with the state’s financial capacity,” states Article 6 paragraph 2 of Perpres 5/2026.

Article 9 of the regulation also explains that Ad Hoc Judges who undertake official travel receive transportation and accommodation costs equivalent to the judges at the relevant court where they are assigned.

Furthermore, ad hoc judges are also given appreciation money. However, the appreciation money will only be given at the end of their term.

“Appreciation money is given in the amount of 2 (two) times the amount of the allowance,” states Article 12 paragraph 2.

Based on the Attachment to Perpres 5/2026, ad hoc judges serving at first-instance courts, which include corruption criminal courts, industrial relations courts, fisheries courts, human rights courts, and commercial courts, will receive an allowance of Rp 49,300,000.

Meanwhile, for the position of ad hoc judges at two types of appellate courts, the allowance is set at Rp 62,500,000.

A significant increase is evident at the highest level, where ad hoc judges serving at four types of cassation courts receive an allowance of Rp 105,270,000.

In response to the increase in ad hoc judges’ allowances, Criminal Law Expert from Trisakti University, Abdul Fickar Hadjar, hopes that the ad hoc judges will be more integrity-driven. A sense of justice is expected to be the foundation for the judges in carrying out their duties.
