TEMPO Interactive, Jakarta:The Home Affairs Ministry has found that 329 regional regulations were problematic throughout 2010. The ministry later asked the regional governments to revise or annul the relevant regulations.

According to Home Affairs Minister Gamawan Fauzi, problems were found after a study was conducted on more than 3,000 regulations. “We found 329 problems with the regional regulations,” he said in Jakarta yesterday.

He said the regulations involved various levies, were not in the public’s interests and impeded the flow of goods between provinces causing a high-cost economy. From 2002 to 2009, 1,878 regional regulations on tax and retribution were annulled. The Home Affairs Ministry conveyed this in a letter to the Supreme Audit Agency (BPK).

Following a meeting with the Regional Representatives Council, Gamawan said his ministry wanted the deputy governor to be a civil servant. This will be included in the regional head election draft, which is now being debated at the Justice and Human Rights Ministry.

Gamawan said the constitution did not mention deputy government candidates. The friction between civil servants would not arise if the deputy governors were civil servants, he said. “It has been suggested the governor elect should choose the deputy,” said Gamawan. It has been suggested that a civil servant deputy governor might impede a governor who has been elected twice to move forward as deputy governor.

Article 110 section 3 of the Law no.32/2004 on Regional Governance cites that: “A regional head and a deputy are in charge for five years as of their installment and can be re-elected after for the same position only once.”
