Developer to be summoned for violation

JAKARTA (JP): The City Council will summon PT Duta Pertiwi, a
private developer who is building a supermarket and office
buildings on Jl. K.H. Hasyim Ashari, Central Jakarta, for
allegedly violating existing regulations.

Saud Rachman, a member of the City Council's Commission D,
which oversees development affairs, said that the developer has
built an apartment building which is not included in its land use
permit.

"The permit clearly states that the city administration has
permitted the developer to use the 80,292-square-meter plot of
land only for a supermarket and office buildings. But in reality
the developer also builds apartments," Saud told reporters
yesterday.

Saud said that the deviation was discovered in a meeting
between the commission members and executives of the developer to
discuss its obligation to provide social and public facilities
around the project site.

During the meeting, the developer revealed that apartments are
being constructed as an integral part of the supermarket and
office building complex.

"This is completely wrong because the permit allows the
developer to build only the supermarket and office buildings," he
reiterated.

Therefore the commission will summon the developer in the near
future to discuss the case.

Saud also said that gubernatorial decree No. 540/1990 is often
violated. According to the decree, each developer that builds
apartments is obliged to provide 20 percent of the total site and
build low-cost apartments on it.

"According to PT Duta Pertiwi's land use permit for the
construction of the supermarket and office buildings, the
developer is required to provide locations for small-scale
traders," Saud said.

Under gubernatorial decree No. 240/1988 developers of
commercial buildings such as supermarkets or shopping malls are
asked to set aside 20 percent of the commercial area for small-
scale traders.

He said that the commission will investigate this matter
because the city administration needs private developers to
participate in the building of low-cost apartments in the city.
