Jakarta (ANTARA) - Coordinating Minister for Law, Human Rights,\nImmigration and Correctional Services Yusril Ihza Mahendra stated that\nconnected jurisdiction will apply if civilians are involved in the case\nof Wakil Koordinator KontraS Andrie Yunus.<\/p>\n
\u201cConnected jurisdiction is already regulated in the new Criminal\nProcedure Code (KUHAP), the Military Court Law, and the TNI Law itself.\nSo, we just wait for the developments,\u201d Yusril said when met after the\n2026 Police Legal Division National Coordination Meeting in Jakarta on\nThursday.<\/p>\n
The statement responded to journalists\u2019 questions regarding a report\nfrom Andrie\u2019s legal team to Bareskrim Polri about alleged civilian\ninvolvement in the acid attack case on Andrie, while the suspect file\ninvolving BAIS TNI members in the case has been handed over to the\nMilitary Court.<\/p>\n
He explained that the report from Andrie\u2019s legal team will first be\nstudied by Polri investigators to confirm the involvement of civilian\nsuspects in the acid attack case.<\/p>\n
If indeed civilians are involved, he said, investigations and\nprosecutions will inevitably proceed under connected jurisdiction, as\npart of it involves military members and part involves civilians.<\/p>\n
\u201cBut if tomorrow, based on reports from various parties and the\npolice conduct investigations and confirm that there are indeed civilian\nsuspects, then this case will inevitably become a connected jurisdiction\ncase,\u201d he said.<\/p>\n
Nevertheless, he added, the connected jurisdiction that will apply\nmeans civilian suspects will be tried in district courts, while military\nsuspects will be tried in military courts.<\/p>\n
Connected jurisdiction is a judicial system for criminal acts\ncommitted jointly by civilians and military personnel. Such cases are\ngenerally tried in general courts but can be transferred to military\ncourts or special teams based on joint investigations.<\/p>\n
Yusril explained that in Indonesia, there are still challenges in\nfully implementing connected jurisdiction due to the absence of\namendments to the Military Court Law.<\/p>\n
Meanwhile, in the TNI Law, he stated that military personnel are\ntried according to the type of criminal act committed. If it concerns\ngeneral criminal acts, they are tried in general courts, but if related\nto military matters, they are tried in military courts.<\/p>\n
\u201cBut the provisions in the TNI Law state that this applies if the\nMilitary Court Law has been amended, and that regulation has not been\nchanged to this day,\u201d the Coordinating Minister revealed.<\/p>\n
Regarding losses<\/p>\n
On the other hand, the former State Secretary explained that the new\nCriminal Procedure Code (KUHAP) considers the aspect of losses, namely\nif a criminal act causes losses to civilians, it is prosecuted in\ncivilian courts, whereas if it harms military interests, it is\nprosecuted in military courts.<\/p>\n
Referring to the provisions of the new KUHAP, he assessed that since\nAndrie Yunus, who was attacked with acid, is a civilian, the loss is to\ncivilians, not the military.<\/p>\n
\u201cTherefore, this case was transferred from police investigation to\nTNI POM.
