        "content": "<p>Coordinating Minister for Law and Human Rights Imipas Yusril Ihza\nMahendra believes that Law No.\u00a031 of 1997 on the Military Judiciary must\nbe revised. He expressed this in response to questions about the\ndevelopments in the acid attack case against KontraS activist Andrie\nYunus by TNI members. \u201cYes, I think the law really needs to be changed.\nIt should have been amended since 2004 with the enactment of the TNI\nSoldier Law. But it hasn\u2019t been changed until now,\u201d Yusril said at the\nPresidential Palace Complex in Jakarta on Monday (27\/4). However, to\ndate, Yusril stated that the government has not taken the initiative to\npropose revisions to the law. He said that regarding that option, the\ngovernment still needs to discuss it first with the DPR. \u201cUnless the DPR\ntakes the lead, that\u2019s fine. Or if someone files it with the\nConstitutional Court, but until that happens, what applies is the\nprovision of the military judiciary law itself,\u201d he said. Yusril\nreminded that the Military Judiciary Law is still in effect to this day.\nHe also recalled his role in drafting the 2004 TNI Law. He explained\nthat if a TNI member commits a general criminal offence, they are tried\nin the general court. Similarly, if they commit a criminal offence in a\nmilitary context, they are tried in the military court. \u201cBut that only\napplies after the Military Judiciary Law is amended. And until now, it\nhasn\u2019t been amended,\u201d he said. He stated that this is the problem. From\nthe three laws in effect, including the Military Judiciary Law, the TNI\nLaw, and the Criminal Procedure Code, they regulate in different ways.\n\u201cSo, until it is not amended or no one files it with the Constitutional\nCourt, what applies is the provision of the military judiciary law. The\nmilitary court does not look at the type of criminal offence committed,\nnor at the harm to which party, military or civilian, but only at the\nsubject,\u201d he said. Regarding the Andrie case, Yusril stated that a\nconnectivity court can only be held if there are suspects from\ncivilians, besides TNI, in the case. However, to date, in the Andrie\ncase, there are no suspects from the civilian side. \u201cWell, I say the\npolice should conduct an investigation to see if there is really\ncivilian involvement. Meanwhile, the process has now proceeded to court.\nBecause the process is already underway, there is no connectivity until\nnow,\u201d he said. The absence of suspects from the civilian side is what,\naccording to Yusril, makes the connectivity court unable to be held in\nthe Andrie case. \u201cConnectivity depends on the perpetrators. If the\nperpetrators are a mix of TNI soldiers and civilians, then connectivity.\nIf only civilians or only military, it\u2019s not relevant to talk about\nconnectivity,\u201d he said.<\/p>",
