Yorrys charge baseless: Lawyer<\/p>\n
JAKARTA (JP): Tommy Sihotang, the lawyer for Yorrys Raweyai of
\nPemuda Pancasila, a powerful youth organization, and three other
\nalleged gamblers, told the West Jakarta District Court yesterday
\nthat the indictment should be annulled.<\/p>\n
"Your Honor, the prosecutor's indictment should be legally
\nannulled because it contains an inaccurate description of the
\ncrime," lawyer Tommy said.<\/p>\n
The lawyer said that the indictment brought forth by
\nprosecutor Noor Said stated that his client made a living from
\ngambling, but provided no basis in fact, or details to support
\nthe charge he was running a gambling business.<\/p>\n
In the court session, which was led by presiding Judge Ismail
\nSebayang, the defense lawyer stressed the importance of an
\naccurate indictment, saying that it will be used as the basis of
\na trial.<\/p>\n
Tommy also said the fact that Yorrys was caught red-handed on
\nJuly 29 at a gambling den in West Jakarta was not enough reason
\nto charge that he had organized or was making a living from the
\ngames played there.<\/p>\n
Prosecutor Noor Said stated on Monday that Yorrys and the
\nother three alleged gamblers had violated three articles of the
\nCriminal Code on gambling, one of which involves the organizing
\nof a gambling den and the use of the proceeds for business
\npurposes.<\/p>\n
The prosecutor also added that the four defendants violated
\nthe 1974 Anti-Gambling Law.<\/p>\n
Another factor used by Tommy to defend his clients concerned
\nthe evidence, which he considered inadequate.<\/p>\n
"The police confiscated `evidence', such as money from the
\nfour defendants' wallets, and took what they defined as `gambling
\nparaphernalia' from a closed cupboard," he said.<\/p>\n
As usual, Yorrys appeared at the court house accompanied by
\nhis wife, Olga. But the number of supporters and Mobile Brigade
\nofficers with him had decreased dramatically.<\/p>\n
Judge Ismail adjourned the trial until Oct. 17 to decide
\nwhether to allow and act on defense lawyer Tommy's statement.<\/p>\n
Yorrys, the day-to-day chairman of the Golkar-affiliated
\nPemuda Pancasila, is being tried along with six other defendants
\non charges of organizing games of chance and playing rummy and
\nmacok at a storehouse at Jl. Daan Mogot 125 in West Jakarta.<\/p>\n
Yorrys was arrested along with six other suspects, but was
\nreleased on bail shortly afterwards.<\/p>\n
The defendants are being tried in two separate trials.<\/p>\n
Yorrys is being tried along with three other alleged gamblers,
\nSundoro Tan, Budianto and Hadi Mustapa. (mas)<\/p>",
