Jakarta, CNBC Indonesia - The United States trade court delivered a\nsignificant blow to President Donald Trump on Thursday (8\/5\/2026). The\ncourt ruled against the 10% global tariffs he imposed after the Supreme\nCourt (SC) overturned many previous import duties.<\/p>\n
The 2-1 decision by the US Court of International Trade temporarily\nblocks the implementation of the tariffs only for two companies and\napplies in the state of Washington. However, it is believed this could\nopen the door to similar outcomes in the future.<\/p>\n
The decision found that Trump\u2019s latest import duties were not\njustified based on the 1970s legislation cited in their implementation.\nTrump imposed the temporary 10% import duties in February, shortly after\nthe SC invalidated many of his global tariffs.<\/p>\n
It should be noted that Trump\u2019s new tariffs were intended to address\nthe balance of payments deficit, citing Section 122 of the 1974 Trade\nAct. These tariffs apply only until the end of July, unless extended by\nCongress.<\/p>\n
However, the Trump administration has also been seeking other ways to\nrebuild its trade agenda after July. US officials have opened new\ninvestigations into dozens of trading partners regarding issues of\nforced labour and overcapacity, alternative methods to impose other\ntariffs.<\/p>\n
\u201cThe Thursday decision by the Court of International Trade orders the\ndefendants to implement the decision within five days, and for the\nimporters who sued in this case to receive refunds,\u201d the court stated,\nas reported by AFP on Friday (8\/5\/2026).<\/p>\n
\u201cThe Trump administration may appeal the trade court\u2019s decision,\u201d it\nadded.<\/p>\n
Trump\u2019s specific sectoral tariffs on goods such as steel, aluminium,\nand cars remain unaffected by this legal challenge. However, Thursday\u2019s\nruling marks the latest complication in Trump\u2019s tariff agenda.<\/p>\n
Since the high court dealt a severe blow to Trump\u2019s economic\npolicies, businesses have also rushed to obtain refunds.<\/p>\n
US Customs and Border Protection estimated in March that more than\n330,000 importers may be eligible for refunds following the Supreme\nCourt decision.<\/p>\n
The previously overturned tariffs were imposed based on the\nInternational Emergency Economic Powers Act. Initially, the policy was\nbelieved to collect around US$166 billion in import duties and estimated\ndeposits.<\/p>\n
\u201cSection 122 was enacted in response to a specific historical crisis\nthat led to the depletion of US currency and gold reserves,\u201d said\nJeffrey Schwab, senior counsel at the Liberty Justice Center, after the\nruling.<\/p>\n
