Update legislation on banking urgent<\/p>\n
JAKARTA (JP): Legal mechanisms related to the economy are
\nurgently needed to fight banking crimes, police said yesterday.<\/p>\n
So far there is not a single law in Indonesia that explicitly
\ndefines banking crimes, National Police Chief Gen. Banurusman
\nAstrosemitro said in a prepared paper which was presented by an
\naide during a seminar held jointly by the School of Criminology
\nof the University of Indonesia and the Police Science Academy.<\/p>\n
\"Police face difficulties in discovering modern banking crimes
\nsuch as those involving automatic teller machines, credit cards
\nand telebanking, since Indonesian legislation has not anticipated
\nsuch banking developments,\" Banurusman said.<\/p>\n
The one-day seminar was held on the theme Portrait of
\nContemporary Economic Crimes in Finance and Banking.<\/p>\n
Banurusman, whose paper was read by his expert staff, Maj.
\nGen. Hadiman, said that the investigation of such crimes was very
\ncomplicated since they could take place anywhere and at any time.<\/p>\n
\"Indonesian laws only concern crimes related to forgery,
\nembezzlement and cheating. We do not have any law concerning
\ncrimes that are related to credit cards or the use of computers
\nin crime,\" Banurusman said.<\/p>\n
\"If such phenomena are not anticipated early, it is possible
\nthat Indonesia will become a target and source for such crimes,\"
\nBanurusman said.<\/p>\n
Central bank data show that, as of June this year, 240 banks
\nwith 6,254 offices and total assets of about Rp 346,886 billion
\nwere operating in Indonesia.<\/p>\n
Laws<\/p>\n
According to Banurusman the lack of laws related with banking
\ncrimes was due to the lengthy legislative procedures.<\/p>\n
Banurusman also noted that generally crimes against banks are
\nconcealed by the victimized banks since their executives are
\nafraid to have their cases made public.<\/p>\n
\"On the other hand, police cannot investigate if there is no
\nreport from the victim bank, he said.<\/p>\n
Meanwhile, economist I Nyoman Moena said that the root of
\nbanking crimes was the mentality of the bankers. He said most
\nIndonesian bankers still thought of banks as trading enterprises.<\/p>\n
\"They run banks on the basis of speculation, as in a trading
\noperation: How to get biggest profit in the shortest possible
\ntime,\" Moena said.<\/p>\n
Such speculation, he said, was dangerous since banks are long-
\nterm businesses.<\/p>\n
As an example he said that almost all cases of bank
\nbankruptcies during the 1960s and 1970s were caused by such
