        "content": "<p>Yogyakarta (ANTARA) \u2014 Criminal law expert from Muhammadiyah\nUniversity of Yogyakarta (UMY), Trisno Raharjo, has stated that the\nhandling of the case involving a Brimob (Mobile Brigade) officer alleged\nto have assaulted a student in Maluku requires the involvement of an\nindependent team.<\/p>\n<p>Trisno said the participation of an independent team is essential to\nensure the objectivity of the investigation, given that the suspect is a\npolice officer.<\/p>\n<p>\u201cThe handling of this case must be conducted openly and\ntransparently,\u201d he said in Yogyakarta on Monday.<\/p>\n<p>According to him, the involvement of an independent team could also\nstrengthen public trust in the outcome of law enforcement\nproceedings.<\/p>\n<p>\u201cI encourage intensive communication between investigators and\nprosecutors, and if necessary, the involvement of human rights activists\nin the case review process to ensure accountability,\u201d Trisno said.<\/p>\n<p>Trisno explained that the legal construction of the case would\nheavily depend on the investigation\u2019s findings.<\/p>\n<p>He noted there are two possibilities regarding the case: a criminal\noffence resulting in death due to negligence, or murder if intentional\nelements are proven.<\/p>\n<p>\u201cBased on preliminary observations, the direction could lead towards\nmurder, particularly given the violent act of using a helmet against a\nchild who was riding a motorcycle. However, reaching a murder charge is\nnot straightforward and must be strongly substantiated,\u201d he\nexplained.<\/p>\n<p>He assessed that proving the element of intent is the crucial point,\nrequiring investigators to examine whether the perpetrator was aware\nthat his actions could potentially cause death, especially as the victim\nwas riding at a certain speed.<\/p>\n<p>Additionally, Trisno questioned whether the patrol and the handling\nof the situation were consistent with Brimob\u2019s core duties and\nfunctions, particularly if the area was in a normal state.<\/p>\n<p>\u201cIf this was not within Brimob\u2019s remit and the situation did not\ninvolve major unrest, then such actions could fall into the category of\nabuse of authority,\u201d he said.<\/p>\n<p>Trisno stated that the perpetrator\u2019s status as a police officer\nshould serve as an aggravating factor rather than a mitigating one, as\nlaw enforcement officers bear greater moral and legal responsibility\nthan civilians.<\/p>\n<p>Previously, according to the chronology provided by the police, the\nincident began when a Brimob patrol was conducting a security operation\nusing a tactical vehicle in the Tual City and Southeast Maluku Regency\narea in the early hours of Thursday (19 February).<\/p>\n<p>The patrol was initially stationed at the Mangga Dua Complex in\nLanggur until approximately 02:00 Eastern Indonesian Time. It then moved\nto Fiditan Village in Tual City after receiving a report from residents\nregarding an alleged assault near the Tete Pancing area.<\/p>\n<p>Upon arriving at the location, the suspect and several other officers\ndisembarked from the vehicle and conducted security measures.\nApproximately 10 minutes later, two motorcycles were travelling at high\nspeed from the direction of Ngadi towards Tete Pancing.<\/p>\n<p>The suspect reportedly swung a tactical helmet as a signal. However,\nthe helmet struck the right temple of the victim, AT (14), causing the\nvictim to fall from the motorcycle face down.<\/p>\n<p>The victim was then rushed to Karel Sadsuitubun Regional General\nHospital in Langgur for medical treatment. However, at 13:00 Eastern\nIndonesian Time, the victim was pronounced dead.<\/p>",
