Transmigration Minister M. Iftitah Sulaiman Suryanagara has confirmed\nthat the government is paving the way to resolve a land issue that has\nbeen hanging for almost 17 years in the Swakarsa Mandiri Transmigration\nSettlement (TSM) SP4, Gambut Jaya Village, Sungai Gelam District, Muaro\nJambi Regency. This certainty emerged during a final case review meeting\nheld by the Ministry of Agrarian Affairs and Spatial Planning\/National\nLand Agency (ATR\/BPN) together with the Ministry of Transmigration in\nJakarta on Monday (29\/6). The meeting was attended by Deputy Minister of\nATR\/BPN Ossy Dermawan, officials from the Ministry of Transmigration,\nthe Muaro Jambi Regency Government, the Jambi Province BPN Regional\nOffice, the Muaro Jambi Regency Land Office, and other relevant\nagencies. The case review is the culmination of a lengthy and careful\nprocess involving document examination, clarification from the parties,\ncross-agency coordination, and a joint field survey. Based on the\nresearch and survey, 67 land parcels were found to be within the\ntransmigration reserve area designated by the Jambi Governor\u2019s Decree\nNumber 285 of 1990. Of these, 50 parcels covering approximately 99.48\nhectares are recommended for further action according to applicable\nlegal mechanisms due to administrative defects. Meanwhile, 17 parcels\ncovering approximately 24.53 hectares, which were found to have no\nadministrative defects, will retain legal protection.<\/p>\n
Iftitah stressed that this matter is not merely about the status of\ncertificates, but about the state\u2019s duty to maintain legal certainty\nover transmigration areas that have been reserved for the public\ninterest. \u201cFor almost 17 years, the transmigration community has been\nwaiting for certainty. The state cannot leave them waiting. Our task is\nto ensure the community\u2019s rights are protected while maintaining legal\ncertainty,\u201d Iftitah said in a statement on Wednesday (1\/7\/2026). He\nnoted that the transmigration community came to the area because they\nanswered the state\u2019s call to develop new regions. Therefore, the state\nhas a moral and legal responsibility to ensure their rights are not\nneglected. \u201cThis issue is not simply a dispute between certificate\nholders and the transmigration community. What is at stake is whether\nthe state continues to respect the decisions it made when it reserved\nthe area for the transmigration programme,\u201d he said.<\/p>\n
Iftitah affirmed that the government remains firmly committed to the\nprinciple of the rule of law. Consequently, every land parcel was\nexamined objectively based on facts and applicable regulations. \u201cThose\nwithout administrative defects remain protected. Conversely, for parcels\nfound to have administrative defects, the state is obliged to follow up\nthrough the applicable legal mechanisms. The state must be fair to all\nparties, but it also cannot allow the rights of the community, who have\nlong awaited certainty, to continue to be neglected,\u201d he explained.\nFurthermore, Iftitah assessed that resolving this case holds strategic\nsignificance, not only for the community in Muaro Jambi but also for\nlegal certainty in transmigration areas across Indonesia. \u201cWhat we are\nprotecting is not just the rights of the transmigration community in\nMuaro Jambi. We are safeguarding the legal certainty of all\ntransmigration areas in Indonesia. Areas that the state has reserved for\nthe people\u2019s interest must have legal certainty so that the\ntransmigration programme can continue to benefit future generations,\u201d he\nstated. He added that if any land parcels ultimately return to state\ncontrol according to the applicable legal mechanisms, their management\nmust be carried out in an orderly manner in accordance with their\ndesignation and the provisions of laws and regulations. \u201cThe ultimate\ngoal is not merely cancellation. The ultimate goal is to ensure that\nstate land is utilised to the greatest extent for the public interest in\na fair, orderly manner and according to its designation,\u201d Iftitah\nclarified.<\/p>\n
Meanwhile, Deputy Minister of ATR\/BPN Ossy Dermawan expressed\nappreciation to all parties who worked professionally, objectively, and\ntransparently throughout the resolution process. \u201cWe hope this case\nreview becomes a crucial point towards an objective, comprehensive, and\naccountable resolution, so that this long-standing issue finally obtains\nlegal certainty,\u201d said Ossy. The Ministry of Transmigration conveyed its\ngratitude to the Ministry of ATR\/BPN, the Muaro Jambi Regency\nGovernment, the Jambi Province BPN Regional Office, the Muaro Jambi\nRegency Land Office, and all parties who contributed to handling this\ncase. Going forward, the Ministry of Transmigration will continue to\ncoordinate with the Ministry of ATR\/BPN and local governments to ensure\nthat every recommendation from the case review is followed up carefully,\nprofessionally, and in accordance with the provisions of laws and\nregulations.
