        "content": "<p>Jakarta (ANTARA) - The Minister of Trade, Budi Santoso, stated that\nthe revision of the Minister of Trade Regulation (Permendag) regarding\nthe implementation of trade through electronic systems (PMSE) aims to\nstrengthen micro, small, and medium enterprises (MSMEs) and consumer\nprotection.<\/p>\n<p>Budi noted that the new PMSE regulations feature five key aspects:\nenhancing the visibility of local products, facilitating business\nlegality, ensuring transparency in digital platform partnerships,\nstrengthening consumer protection, and improving digital technology\ngovernance.<\/p>\n<p>\u201cThe refinement of PMSE regulations through this new Permendrag aims\nto encourage a fair, healthy, and beneficial digital trade ecosystem.\nThis is being done while considering dynamic technological\ndevelopments,\u201d Budi said in a written statement received in Jakarta on\nFriday.<\/p>\n<p>Furthermore, he explained that the primary regulations include\nprioritising the visibility of domestic micro and small enterprises\n(MSEs) on platforms, the obligation to possess business licences,\ntransparency regarding platform fees and promotional policies, and the\nprovision of promotional incentives for MSEs.<\/p>\n<p>The regulations also cover the provision of complaint and dispute\nmechanisms by platforms, the use of Artificial Intelligence (AI) in\npromotional and marketing activities, and protection against unfair\ntrade practices.<\/p>\n<p>Additionally, two new business models for PMSE Providers (PPMSE) have\nbeen added. The first is Ride-Hailing, defined as an electronic system\nin the land transportation sector that may include features for trading\ngoods or services as additional services within the same ecosystem. The\nregulation for ride-hailing targets the trading of goods facilitated by\nthe platform through the commercial features of ride-hailing\napplications.<\/p>\n<p>\u201cThus, what is regulated is the transaction of buying and selling\ngoods, not the transportation service itself,\u201d said Budi.<\/p>\n<p>The second business model is the Online Travel Agent (OTA). This\nmodel involves an electronic system for the sale or booking of travel\nservices to consumers, either directly or through facilitated\ntransactions between consumers and businesses selling transport tickets,\naccommodation, attractions, or travel packages.<\/p>\n<p>Regarding the obligation for all traders on platforms to hold\nbusiness licences, Budi emphasised the need for such regulation to\ncreate a more orderly and healthy digital trade ecosystem. This\nregulation also aims to provide legal certainty for businesses and\nprotection for consumers.<\/p>\n<p>To allow for adequate adaptation, the government has established a\ngrace period for businesses to meet their licensing obligations. He\nexpressed hope that the transition towards a more formal digital trade\necosystem would proceed gradually and without undue burden.<\/p>\n<p>\u201cThis regulation is an initial step. We will continue to provide\nsupport through synergy, coaching, and assistance for businesses via\nsocialisation, training, and promotion, both online and offline. A\nhealthy digital ecosystem can be realised if we build it together,\u201d he\nsaid.<\/p>\n<p>The latest draft of the Permendag has been signed by Budi. This\nregulation will replace Permendag Number 31 of 2023 concerning Business\nLicensing, Advertising, Development, and Supervision of Business Actors\nin Trade Through Electronic Systems.<\/p>",
