        "content": "<p>The Advocacy Team for Democracy (TAUD), also serving as legal counsel\nfor Andrie Yunus, rejects the processing of the acid attack case by\nmilitary court. According to Fadhil Alfathan, the acid attack on Andrie\nYunus constitutes a general criminal offence with no connection to\nmilitary functions.<\/p>\n<p>\u201cFrom the start, we have rejected the military court process in this\ncase with various arguments we presented some time ago. This has nothing\nto do with military duties and functions. Moreover, it was carried out\nagainst a civilian, Andrie,\u201d Fadhil told reporters at the Constitutional\nCourt building in Central Jakarta on Wednesday (8\/4\/2026).<\/p>\n<p>He explained that the acid attack case at the police has not been\nhalted despite being handed over to the TNI. He believes the case should\nbe processed through general courts.<\/p>\n<p>\u201cAnd the criminal act committed is a general criminal offence, so the\njurisdiction and authority in this context belong to the general courts.\nIndeed, up to now, there is no certainty. Even at the Metro Jaya Police,\nto this day, they have not issued a letter to stop the investigation\ndespite the handover,\u201d he said.<\/p>\n<p>Fadhil criticised the police\u2019s case transfer process. In his view,\nthe transfer lacks basis and is premature.<\/p>\n<p>\u201cAnd we criticise that transfer process; in our opinion, it is\nbaseless and still very premature because to this day, our independent\nand autonomous investigation team has succeeded in identifying at least\n16 perpetrators. This means it is far from over, and the transfer is\nwithout legal basis and very premature,\u201d he stated.<\/p>\n<p>\u201cOf course, formally, it will be problematic. Formally, in the\nmilitary court, Andrie\u2019s testimony as the victim is important. But the\nform, in our view, is still a big question and dispute. For us, this\nshould be tried in general courts,\u201d he continued.<\/p>\n<p>He said his side is filing a lawsuit against the TNI Law at the\nConstitutional Court regarding the military court mechanism. The lawsuit\nis an effort to ensure the case is tried in general courts.<\/p>\n<p>\u201cOne effort is that we have conveyed to the Constitutional Court to\nimmediately decide our petition, one of the objects of which is Article\n74 of the TNI Law, which has been used as a pretext to try soldiers who\ncommit general criminal offences in military courts. That\u2019s the first,\u201d\nhe explained.<\/p>\n<p>Furthermore, Fadhil stated they will file a report with Bareskrim\nPolri regarding the acid attack case. He wants the police to continue\nthe case.<\/p>\n<p>\u201cThen we also urge the police to immediately process this further,\nincluding pushing for a police report filed by Andrie in the form of a\nmodel B police report, which will also be submitted to Bareskrim Polri\ntoday,\u201d he said.<\/p>\n<p>He also urged authorities and other stakeholders to take steps\naccording to their main duties and functions. He also mentioned that the\nDPR has not been optimal in carrying out its oversight function,\nespecially in this case.<\/p>\n<p>\u201cOn 31 March, we had an RDPU with Commission III, but to this day, we\nhave not found any results from that RDPU. Including Commission I\nregarding intelligence work, or Commission XIII regarding human rights,\nwe have not received further information on what they have done.
