Convicted in a corruption case involving the seizure of forest land,\nSurya Darmadi has requested a transfer from Nusakambangan Prison in\nCilacap, Central Java. Surya claimed he cannot sleep and is stressed at\nNusakambangan Prison.<\/p>\n
This was stated by Surya Darmadi during the trial of the corruption\ncase involving the defendant corporation PT Duta Palma Group at the\nJakarta Corruption Court on Friday (10\/4\/2026). Surya questioned why\nonly his company was being prosecuted in the matter.<\/p>\n
\u201cYour Honour, my health condition is very serious. Every morning at 2\na.m. I wake up, I am stressed, I cannot sleep. Why am I at Nusakambangan\ntoday? Why are thousands of companies only mine being prosecuted, the\nothers not? If I have a severe heart attack, I will not last long, Your\nHonour, if I stay at Nusakambangan. Here, medical care, food,\neverything, it takes time to respond. In the near future, I will release\nmy biography, Your Honour. Thank you, Your Honour,\u201d said Surya Darmadi\nvirtually from Nusakambangan Prison.<\/p>\n
Surya Darmadi apologised to the Attorney General\u2019s Office (Kejagung).\nHe said his assets have already been seized and he has been\nimpoverished.<\/p>\n
\u201cI apologise to the Attorney General\u2019s Office, I am sorry if I have\ndone wrong. My assets have been seized, I have been impoverished, is\nthat not enough, move me to Nusakambangan,\u201d he said.<\/p>\n
Then, Surya\u2019s lawyer provided additional responses. He mentioned that\nSurya had entrusted a letter regarding his health condition and\ndetention due to his age of 74 years.<\/p>\n
\u201cThere is an addition, regarding what Mr Surya Darmadi said verbally.\nHe also entrusted a letter through us regarding a statement and request\nrelated to his health condition and detention. Perhaps this is the\numpteenth request that personally, in terms of age, he is over 70 years\nold,\u201d said Surya\u2019s lawyer.<\/p>\n
\u201c74 years,\u201d interjected Surya.<\/p>\n
Surya\u2019s lawyer said his client suffers from heart disease. According\nto him, the facilities at Nusakambangan Prison are not adequate enough\nfor an elderly person with a serious illness.<\/p>\n
\u201cHe suffers from heart disease and uses a pacemaker, already fitted\nwith the device. That is very sensitive if the battery dies, perhaps he\nwould be like that too. Then, other humanitarian aspects, the facilities\nat Nusakambangan are not quite adequate for someone who is elderly and\nill,\u201d he said.<\/p>\n
Surya\u2019s lawyer requested that his client\u2019s rights be fulfilled. He\nalso expressed objections to the planned execution of the seizure of the\nMenara Palma Building.<\/p>\n
\u201cFurthermore, this is regarding the assets that are being executed by\nthe Attorney General\u2019s Office, namely the Menara Palma Building, which\nis owned by or in the name of PT Wana Mitra Permai, which has never been\na defendant, has never been decided by a court with final legal force in\nany case, civil, criminal, or corruption crime,\u201d said Surya\u2019s\nlawyer.<\/p>\n
\u201cHowever, the Menara Palma Building which has been renamed Gedung\nAgrinas Palma Nusantara, documents are being requested and execution is\nbeing carried out on it. There is a letter from him and his directors\nthrough us,\u201d he added.<\/p>\n
Surya then commented on his lawyer\u2019s statement. Surya said he had\nnever found a custody letter from the Attorney General\u2019s Office\nregarding the building.<\/p>\n
\u201cYour Honour, our building has been taken over by Agrinas because\nthere is a custody from the Attorney General\u2019s Office. But we requested\nthe custody letter, there is none, we went to the Attorney General\u2019s\nOffice to request the custody letter, there is none. So in this country,\nthere is no legal certainty,\u201d said Surya Darmadi.<\/p>\n
The chief judge, Purwanto S Abdullah, then responded. He said Surya\nis at Nusakambangan Prison because he is serving a sentence from a\nprevious case.<\/p>\n
\u201cMr Surya and the advocate, regarding this request, in this case the\npanel is trying the corporation case. Perhaps Mr Surya was placed at\nNusakambangan in the capacity of serving a sentence,\u201d said Purwanto.<\/p>\n
\u201cSo the panel of judges has never issued a detention order or\nanything against Mr Surya, but previously Mr Surya was requested to be\npresent at the trial for the purpose of examination in the corporation\ncase,\u201d he added.<\/p>\n
Surya Darmadi said this corporation case is a repetition of the\nprevious case, namely the one decided by the Supreme Court (MA) number\n4950\/K.Pid.Sus\/2023. Surya considered this corporation case as nebis in\nidem.<\/p>\n
\u201cYour Honour, I know that this is nebis in idem, already decided by\nthe Supreme Court, first the individual, now the corporation. Next the\ngrandchildren. Sorry,\u201d said Surya Darmadi.<\/p>\n
The judge immediately responded to Surya and asked him to coordinate\nwith the Directorate General of Corrections (Ditjen Pas) regarding\ndetention. Surya said there is intervention to Ditjen Pas so he is not\ntransferred from Nusakambangan.<\/p>\n
\u201cSo regarding detention, perhaps coordinate with the Attorney\nGeneral\u2019s Office or Dirjen Pas,\u201d said the judge.<\/p>\n
\u201cDirjen Pas always wants to help but says there is intervention so he\ndoesn\u2019t dare,\u201d interjected Surya.<\/p>\n
\u201cThat is outside the panel, but the panel only wants this case to be\nresolved quickly,\u201d said the judge.<\/p>\n
Surya asked the panel of judges to provide input to Ditjen Pas\nregarding his health condition so that they would consider transferring\nhim from Nusakambangan. The panel of judges said they would try.<\/p>\n

Previously, the corporation PT Duta Palma Group was charged with\ncausing losses to the state finances of Rp 4.79 trillion and USD 7.88\nmillion related to alleged corruption and money laundering crimes (TPPU)\nin illegal palm oil plantation business activities in Indragiri Hulu\nRegency, Riau. This was done in the period 2004-2022.<\/p>\n
