        "content": "<p>Jakarta, CNBC Indonesia \u2014 Commission XI of the DPR RI has begun\ndeliberating the Draft Law (RUU) amending the State Finance Law using an\nomnibus law approach. The scheme was chosen to align various rules\naffected by the birth of several new regulations, including the revision\nof the State-Owned Enterprise (SOE) Law.<\/p>\n<p>The Chairman of Commission XI of the DPR RI, Mukhamad Misbakhun, said\ndeliberation of the bill is still at the stage of gathering input from\nacademics and experts in economics and law.<\/p>\n<p>\u201cThis meeting concerns the State Finance Amendment Bill using the\nomnibus law system, in which we are listening to input as part of\nmeaningful participation, to be considered in the substance of the bill\nat the working committee meeting,\u201d Misbakhun said when opening the\nPublic Hearing (RDPU) of the State Finance Bill Working Committee at the\nParliamentary Complex, Senayan, Jakarta, on Monday (14\/9\/2026).<\/p>\n<p>At the hearing, Commission XI invited several experts: Dewi Kania\nSugiharti, a law lecturer at Padjadjaran University; Tauhid Ahmad, a\nsenior economist at INDEF; Candra Fajri Ananda, a professor at the\nFaculty of Economics and Business at Brawijaya University; and Dian Puji\nNugraha Simatupang, a lecturer in State Administrative Law at the\nUniversity of Indonesia.<\/p>\n<p>Misbakhun explained that the revision of the State Finance Law is\nnecessary to adjust to various changes that emerged following the\nissuance of Law Number 1 of 2025 and Law Number 16 of 2025, which\nrevised the rules on SOEs.<\/p>\n<p>The State Finance Bill is one of the bills included in Commission\nXI\u2019s Priority National Legislation Programme (Prolegnas) for 2026, using\nthe omnibus law method.<\/p>\n<p>For context, the use of the omnibus law method follows the enactment\nof Law Number 1 of 2025 on State-Owned Enterprises and Law Number 16 of\n2025 on the Fourth Amendment to Law Number 19 of 2003 on State-Owned\nEnterprises, which brought fundamental changes to SOE governance.<\/p>\n<p>One of the most scrutinised aspects of the bill is the transfer of\nthe Finance Minister\u2019s role as state shareholder in SOEs to the\nInvestment Management Agency (BPI) Danantara.<\/p>\n<p>\u201cThe SOE Law has removed the Finance Minister as the shareholder of\nSOEs, with that role now taken over by BPI Danantara,\u201d Misbakhun said\nsome time ago (10\/2\/2026).<\/p>\n<p>This change, he continued, also affects the mechanism for managing\nSOE dividends. Previously, SOE dividends were recorded as non-tax state\nrevenues (PNBP), but now they are reinvested by BPI Danantara to\nstrengthen strategic sectors and drive national economic growth.<\/p>\n<p>\u201cSo there are several things there that we need to rearrange,\u201d said\nMisbakhun.<\/p>\n<p>Furthermore, he said, the change in the SOE management structure has\ndirect implications for the State Budget (APBN), particularly regarding\nthe Finance Minister\u2019s function as General Treasurer of the State.<\/p>\n<p>Therefore, on behalf of Commission XI of the DPR RI, he sees the need\nfor a comprehensive overhaul of the legal framework for state finances,\ncovering the State Finance Law, the State Treasury Law, the State Wealth\nLaw, and other laws in the financial sector that are affected.<\/p>\n<p>In the discussion on meaningful participation, one issue that drew\nattention was the optimisation of Non-Tax State Revenues (PNBP).<\/p>\n<p>Senior INDEF economist Tauhid Ahmad assessed that Indonesia\u2019s PNBP\npotential remains underexploited. According to him, there are various\nproblems, ranging from diverse tariff structures, services that have not\nimproved, to the management of PNBP receivables.<\/p>\n<p>\u201cThere are many issues currently being faced, including related\nministries and agencies that still rely on manual services that are\noften slow, tariffs not accompanied by improvements in quality,\nespecially at PNBP-implementing institutions, and issues relating to\nPNBP receivables,\u201d said Tauhid.<\/p>\n<p>He also highlighted the still limited regulation governing PNBP from\nthe new and renewable energy (EBT) sector. At present, he said, PNBP\nschemes are largely applied only to geothermal energy, while other\nsources such as solar, wind, and bioenergy lack an adequate regulatory\nbasis.<\/p>\n<p>\u201cFor example, PNBP on renewable energy is still related to\ngeothermal. Solar, wind, and bioenergy have not yet been accommodated\nbecause the government regulations do not exist,\u201d he said.<\/p>\n<p>Therefore, Tauhid proposed periodic evaluations of PNBP tariffs,\nstronger data integration, and the imposition of windfall profit levies\non the natural resources (SDA) sector when commodity prices soar.<\/p>\n<p>\u201cTariff optimisation is also needed, including the imposition of\nwindfall profit on natural resources,\u201d he said.<\/p>",
