Political analyst Saiful Mujani now faces legal proceedings stemming\nfrom his statements narrated as inciting the overthrow of President\nPrabowo Subianto.<\/p>\n
Mujani was reported by an individual named Robina Akbar from the East\nJakarta Community Alliance to the Metro Jaya Police regarding alleged\nincitement. The report was registered under number\nLP\/B\/2428\/IV\/2026\/SPKT\/POLDA METRO JAYA, dated 8 April 2026.<\/p>\n
\u201cYes, it is true he was reported on Wednesday, 8 April 2026, around\n21:30 WIB,\u201d said the Head of Public Relations of Metro Jaya Police,\nKombes Budi Hermanto, when contacted on Thursday (9\/4).<\/p>\n
In the report, the complainant accused Saiful under Article 246 of\nthe Criminal Code. This article regulates incitement against public\nauthorities with a maximum penalty of four years\u2019 imprisonment.<\/p>\n
\u201cRegarding Article 246 of Law 1\/2023,\u201d Budi stated.<\/p>\n
Police are still investigating the report against Mujani. The\ncomplainant will later be clarified and asked for statements regarding\nthe report, including the reasons for filing it.<\/p>\n
Mujani has spoken out about the report. According to him, the report\nis a legitimate step, but it would be better if his statements were\nresponded to with a reply.<\/p>\n
\u201cA legitimate step. But since this is in the realm of civil society\nand in the form of attitudes and opinions, it should just be responded\nto,\u201d Saiful said when confirmed.<\/p>\n
Mujani also stated that involving law enforcement authorities, in\nthis case the police, to handle citizens\u2019 opinions could impact\ndemocracy.<\/p>\n
\u201cIt\u2019s not good for democracy if the state [police] gets involved in\nhandling citizens\u2019 opinions and political attitudes, unless I have\nphysically harmed someone or deprived someone of their freedom and\nrights,\u201d he said.<\/p>\n
\u201cJust refute it, counter criticism with criticism, but it\u2019s fine if\nthey want to show more clearly that this country is becoming\nincreasingly fascist,\u201d he added.<\/p>\n
Meanwhile, former Coordinating Minister for Political, Legal, and\nSecurity Affairs Mahfud MD assessed that Saiful Mujani\u2019s statements\nregarding overthrowing President Prabowo Subianto cannot be categorised\nas treason.<\/p>\n
Mahfud explained that in the new Criminal Code (KUHP), treason is\nregulated in one article, namely Article 193.<\/p>\n
\u201cThe term treason is actually regulated in just one article, Article\n193, two paragraphs, the first of which refers to treason intended to\noverthrow a government not in accordance with the Constitution. So, it\nintends to overthrow,\u201d Mahfud said, quoted from a post on his personal\nYouTube account, Thursday (9\/4).<\/p>\n
This constitutional law expert stated that the KUHP explains that\noverthrowing the government means eliminating or changing the structure\nof the government in an unlawful manner according to the 1945\nConstitution of the Republic of Indonesia.<\/p>\n
According to him, Saiful Mujani\u2019s statements cannot be said to fall\ninto the category of treason if not followed by actions.<\/p>\n
\u201cNow, when does a speech eliminate? And what are the steps? What is\nbeing changed?\u201d Mahfud said.<\/p>\n
\u201cTherefore, in Saiful Mujani\u2019s statements, there is absolutely no\nelement in the new KUHP Article 193, namely replacing and eliminating\nthe government structure. Remember, it says government structure there.\nWhat is meant by government structure? The structure or the officials?\nIt\u2019s not clear, so calling it treason immediately is wrong, wrong, too\nemotional,\u201d he added.<\/p>\n
Nevertheless, Mahfud admitted he does not agree with efforts to\noverthrow the government in the middle of its term because it would only\ncreate further problems.<\/p>\n
