        "content": "<p>Suspects in the case of alleged false claims about 7th President of\nthe Republic of Indonesia Joko Widodo\u2019s (Jokowi) diploma, Roy Suryo and\nTifauziah Tyassuma, also known as Doctor Tifa, reportedly refused to\nsign the official report on the transfer of their detention from Polda\nMetro Jaya to the South Jakarta District Attorney\u2019s Office (Kejari\nJaksel). This was revealed by their legal counsel, Ahmad Khozinudin,\nfollowing the phase two handover at the South Jakarta District\nAttorney\u2019s Office on Monday (22\/6). \u201cThe official report on the transfer\nof detention from the Polda to the Prosecutor\u2019s Office was not signed,\nit was refused, and indeed it is not relevant,\u201d he said at the Kejari\nJaksel. Khozinudin stated that neither the old Criminal Code (KUHP) nor\nthe new one mandates detention during the phase two process. According\nto him, detention can only be carried out if there are subjective or\nobjective elements from the investigator, such as concerns about the\nsuspect fleeing, destroying evidence, or committing another criminal\nact. \u201cFrom the beginning, the suspect status of both Roy Suryo and Tifa\nwas never detained. This confirms that there were indeed no concerns\nabout either of them fleeing, destroying evidence, or committing the\nalleged criminal act,\u201d he said. \u201cBecause there is no detention status,\nthe phase two process is not about transferring detainee status from the\nPolda to the Prosecutor\u2019s Office,\u201d he continued. Khozinudin also\nrevealed that Roy was forced by the police to wear a detainee\u2019s vest\nduring the handover process. It is known that Roy never wore a\ndetainee\u2019s vest when he was taken from the Polda Metro Jaya detention\ncentre to the Kramat Jati Police Hospital for a medical examination. Roy\nalso did not wear a detainee\u2019s vest when he was brought back to Polda\nMetro Jaya from the Police Hospital, including when he was taken from\nPolda Metro Jaya to the Kejari Jaksel for the handover. Roy was only\nseen wearing a detainee\u2019s vest upon arrival at the Kejari Jaksel, and he\nwas also seen wearing red cable ties. \u201cEarlier, there was an attempt at\nforce by Polda Metro Jaya investigators to put a detainee\u2019s vest on him.\nThis is a violation, because there is not a single law, neither the KUHP\nnor the Criminal Procedure Code (KUHAP), that requires wearing a\ndetainee\u2019s vest during the handover process,\u201d said Khozinudin.\nKhozinudin also brought up the defamation and slander case involving\nformer Vice President Jusuf Kalla (JK) that implicated Silfester\nMatutina, noting that Silfester has yet to be taken into custody. \u201cThe\none with criminal status is Silfester Matutina. Because Silfester\nMatutina\u2019s case has permanent legal force and should have been executed\nby the South Jakarta District Attorney\u2019s Office. That is what should be\nsubject to coercive measures,\u201d he said. \u201cAnd earlier there was a debate\nbecause the police consider wearing a detainee\u2019s vest to be part of the\nPolice SOP,\u201d he added. Polda Metro Jaya\u2019s Head of Public\nRelations, Commissioner Budi Hermanto, clarified public opinion while\nresponding to accusations of oppressive actions in the coercive measures\ntaken by investigators. \u201cThe Indonesian National Police is not\nanti-criticism and we are grateful for the input provided. However, we\nneed to clarify to the public that the entire legal process carried out\nby investigators is actually highly respectful of human rights,\u201d Budi\nsaid in Jakarta on Monday.
