Row over disputed plot at BSD goes on<\/p>\n
TANGERANG (JP): A dispute over a 2.5-hectare plot of land at
\nBumi Serpong Damai housing complex continued after the claimant
\ninsisted on measuring the land according to his estimates rather
\nthan relying on measurements done by the National Land Agency
\n(BPN).<\/p>\n
On Friday officers of the Tangerang District Court, who were
\nin charge of measuring the claimant's land, also disregarded a
\ndecision taken by the West Java High Court on Wednesday in which
\nit announced a postponement of the clearance of the disputed
\nland.<\/p>\n
The disputed plot is claimed by the housing complex and Rusli
\nWahyudi, a resident of South Jakarta.<\/p>\n
The court decided on clearance postponement on the grounds
\nthat there was a difference of opinion over the precise location
\nof the disputed land and was aimed at preventing any overlap in
\nclearance implementation, Abdul Kadir, deputy chairman of the
\nhigh court, said.<\/p>\n
However, Ansori Thoyib, a clerk of the Tangerang District
\nCourt, said that as the high court's decision was not explicit
\nabout the postponement, land clearance would go ahead.<\/p>\n
\"We will install poles in line with instructions from court
\nofficers in charge of the clearance,\" Ansori said.<\/p>\n
Meanwhile, Arief Setyabudi Cany, head of BPN's Tangerang
\noffice, said that BPN officers remeasuring the disputed land on
\nWednesday discovered that demolition work had been undertaken at
\nthe wrong site, leading to a clash between security guards and
\nofficers of the Tangerang District Court on Dec. 5.<\/p>\n
Court request<\/p>\n
Arief said the land was remeasured at the request of the
\ndistrict court, in order to verify the exact location of the
\nplot.<\/p>\n
The land measuring by court officers on Thursday sparked a
\nheated debate with owners of 68 houses believed to have been
\nlocated on the disputed land.<\/p>\n
\"What is the use of BPN remeasuring the land, if its results
\nare turned down by the claimant, who later does his own
\nmeasurements based on his estimates?\" the residents asked.<\/p>\n
The residents said the court officers were inconsistent in
\nmeasuring the land as ordered by the claimant.<\/p>\n
The court should coordinate with BPN before measuring the land
\nso as to prevent any unrest among the residents, they said.
