The South Sulawesi High Prosecutor\u2019s Office has halted the\nprosecution of an assault case involving a young man with the initials F\n(19) from East Luwu through a restorative justice mechanism.<\/p>\n
Head of the South Sulawesi High Prosecutor\u2019s Office Muhammad\nSyarifuddin in Makassar on Tuesday said the termination of prosecution\ntook into account the social condition of the suspect, who had just\ngraduated from high school and intended to continue his education at\nuniversity.<\/p>\n
\u201cBased on the considerations, the social condition of the suspect is\nthat he has just graduated from high school and has the intention to\ncontinue his education to the university level,\u201d Syarifuddin said during\na virtual case exposure at the South Sulawesi High Prosecutor\u2019s\nOffice.<\/p>\n
The termination of prosecution was carried out after both parties\nagreed to reconcile through a mediation process at the Wotu District\nProsecutor\u2019s Branch Office, East Luwu Regency, on 10 August 2026.<\/p>\n
The peace process also received a positive response from religious\nleaders, community leaders, and the local village government.<\/p>\n
The restorative justice request submitted by Head of the Wotu Branch\nProsecutor\u2019s Office Ridwan together with Facilitator Prosecutors Fatimah\nAyu Safitri and Yusa Putra Widyatama was then approved by the leadership\nof the South Sulawesi High Prosecutor\u2019s Office in a virtual\nexposure.<\/p>\n
At the time of the incident, the suspect was gathered with his\nfriends. They then heard shouts for help from the direction of the\nentrance to a football field.<\/p>\n
The suspect and his friends approached the source of the sound and\nfound the victim MTI and a female witness crying.<\/p>\n
One of the suspect\u2019s friends then asked the victim a question and\nimmediately punched him. The suspect and his friends also participated\nin the violence by kicking the victim\u2019s waist twice.<\/p>\n
As a result of the incident, the victim suffered bruising on the\neyelid, scratches on the cheek and neck, and tenderness in the back. The\nvictim has now recovered.<\/p>\n
The suspect was charged with violating Article 262 paragraph (1) of\nthe Criminal Code or Article 466 paragraph (1) of the Criminal Code in\nconjunction with Article 20 letter c of the Criminal Code related to the\ncriminal act of violence against the victim MTI.<\/p>\n
Syarifuddin emphasised that the request to terminate prosecution had\nfulfilled the applicable legal requirements. He also appreciated the\nefforts of the Wotu Branch Prosecutor\u2019s Office in resolving the case\nthrough a restorative justice approach.<\/p>\n
He instructed the Head of the Wotu Branch Prosecutor\u2019s Office to\nimmediately request a restorative justice approval order from the local\nDistrict Court.<\/p>\n
If the suspect is still in detention, Syarifuddin requested that the\nperson concerned be released immediately after the District Court grants\nthe restorative justice approval.<\/p>\n
\u201cIt should be noted for prosecutors that transactional practices are\nprohibited and must not occur in case resolution.
