        "content": "<p>&apos;Rape victim&apos;s parents could sue hospital&apos;<\/p>\n<p>JAKARTA (JP): The parents of a teenage girl allegedly raped by<br>\na cleaning service worker at the Cipto Mangunkusumo General<br>\nHospital (RSCM) could sue RSCM for negligence and causing her<br>\nmental anguish, police and a criminologist said yesterday.<\/p>\n<p>Central Jakarta Police Chief Lt. Col. M. Ibrahim said the<br>\npolice could question the hospital if they received a complaint<br>\nfrom the victim&apos;s parents.<\/p>\n<p>&quot;We cannot questions the hospital for further investigation<br>\nunless the girl&apos;s family officially reports to us,&quot; Ibrahim said.<br>\nThe police have only investigated the criminal aspects of the<br>\nattempted rape case so far.<\/p>\n<p>A 16-year-old girl was reportedly raped by a cleaning service<br>\nworker at RSCM last Friday night after he crept into her room in<br>\nthe left wing of the hospital.<\/p>\n<p>The girl&apos;s right leg was amputated a couple of days earlier,<br>\nand she was lying helpless, her mother sleeping outside, when the<br>\nman entered the room.<\/p>\n<p>The victim, Sis, a third-year junior high school student was<br>\nhospitalized after a Roda Niaga minibus hit her on Jl. M. Toha,<br>\nTangerang, West Java.<\/p>\n<p>RSCM&apos;s director M. Ahmad Djojosugito, denies the girl was<br>\nraped.<\/p>\n<p>Ahmad said the incident was a rape attempt, the girl has been<br>\nmoved to another room to keep her from meeting reporters and the<br>\nhospital would not charge the family for treatment.<\/p>\n<p>Criminologist Adrianus Meliala told The Jakarta Post yesterday<br>\nthe girl&apos;s family should sue the hospital negligence, under<br>\narticles 1366 and 1367 of the Civic Code.<\/p>\n<p>Under article 1367, the hospital can be sued if a person<br>\nemployed by the hospital harms a patient undergoing treatment<br>\nthere.<\/p>\n<p>Citing a similar case last year at the Pelni hospital,<br>\nAdrianus said the court had accepted the indictment against the<br>\nhospital.<\/p>\n<p>&quot;However, in Indonesia, people tend to be forgiving and, added<br>\nto the many non-legal considerations, the punishment given to the<br>\nculprits is often too lenient,&quot; he said.<\/p>\n<p>Adrianus said apart from paying the bills and getting<br>\ntreatment, most patients were not aware of their rights and<br>\nprivileges because many hospitals do not clearly explain them.<\/p>\n<p>&quot;Let&apos;s learn from these incidents. This is the time for<br>\nhospitals to improve their services, including giving detailed<br>\nexplanations on the hospital-patient relationship and what they<br>\nshould get during treatment,&quot; he said.
