'Rape victim's parents could sue hospital'<\/p>\n
JAKARTA (JP): The parents of a teenage girl allegedly raped by
\na cleaning service worker at the Cipto Mangunkusumo General
\nHospital (RSCM) could sue RSCM for negligence and causing her
\nmental anguish, police and a criminologist said yesterday.<\/p>\n
Central Jakarta Police Chief Lt. Col. M. Ibrahim said the
\npolice could question the hospital if they received a complaint
\nfrom the victim's parents.<\/p>\n
"We cannot questions the hospital for further investigation
\nunless the girl's family officially reports to us," Ibrahim said.
\nThe police have only investigated the criminal aspects of the
\nattempted rape case so far.<\/p>\n
A 16-year-old girl was reportedly raped by a cleaning service
\nworker at RSCM last Friday night after he crept into her room in
\nthe left wing of the hospital.<\/p>\n
The girl's right leg was amputated a couple of days earlier,
\nand she was lying helpless, her mother sleeping outside, when the
\nman entered the room.<\/p>\n
The victim, Sis, a third-year junior high school student was
\nhospitalized after a Roda Niaga minibus hit her on Jl. M. Toha,
\nTangerang, West Java.<\/p>\n
RSCM's director M. Ahmad Djojosugito, denies the girl was
\nraped.<\/p>\n
Ahmad said the incident was a rape attempt, the girl has been
\nmoved to another room to keep her from meeting reporters and the
\nhospital would not charge the family for treatment.<\/p>\n
Criminologist Adrianus Meliala told The Jakarta Post yesterday
\nthe girl's family should sue the hospital negligence, under
\narticles 1366 and 1367 of the Civic Code.<\/p>\n
Under article 1367, the hospital can be sued if a person
\nemployed by the hospital harms a patient undergoing treatment
\nthere.<\/p>\n
Citing a similar case last year at the Pelni hospital,
\nAdrianus said the court had accepted the indictment against the
\nhospital.<\/p>\n
"However, in Indonesia, people tend to be forgiving and, added
\nto the many non-legal considerations, the punishment given to the
\nculprits is often too lenient," he said.<\/p>\n
Adrianus said apart from paying the bills and getting
\ntreatment, most patients were not aware of their rights and
\nprivileges because many hospitals do not clearly explain them.<\/p>\n
"Let's learn from these incidents. This is the time for
\nhospitals to improve their services, including giving detailed
\nexplanations on the hospital-patient relationship and what they
