Prosecutor says Bank Bali 10 dossiers lacking<\/p>\n
JAKARTA (JP): The Jakarta Prosecutor's Office has rejected
\ndossiers of the 10 suspects in the Bank Bali scandal due to a
\n\"minor technicality\", a senior official at the National Police
\nsaid on Monday.<\/p>\n
Police spokesman Brig. Gen. Togar Sianipar said the
\nprosecutor's office wanted the suspects to be listed according to
\na clear definition of the charges they faced.<\/p>\n
He said the dossiers should have been put into two categories
\n-- one for those who allegedly breached Banking Law No. 10\/1998,
\nand the other for suspects who violated Article 372, concerning
\nembezzlement, of the Criminal Code.<\/p>\n
\"It's a minor technicality. We'll make the changes as soon as
\npossible and return the dossiers to them. This is normal. It
\nhappens all the time,\" Togar said at National Police
\nHeadquarters.<\/p>\n
The police sent the dossiers of the 10 suspects on Thursday.
\nThe suspects are former Bank Bali president Rudy Ramli and four
\nformer directors and senior managers of the bank, two deputy
\nchairmen of the Indonesian Bank Restructuring Agency (IBRA), two
\nbusinessmen affiliated with President B.J. Habibie's inner circle
\nin the ruling Golkar Party and an official of Bank Indonesia.<\/p>\n
Analysts were quick to decry the rejection of the dossiers as
\na further indication of the government's foot-dragging in the
\ninvestigation of the scandal, which was first exposed in the
\nmedia in July.<\/p>\n
In a related development, chief of the Supreme Audit Agency
\n(BPK) Satrio Billy Yudono stressed on Monday that he would not
\ndisclose the full PricewaterhouseCoopers (PwC) audit report on
\ntransactions in the scandal despite pressure from the
\nInternational Monetary Fund (IMF) and the World Bank.<\/p>\n
\"I've said this several times already,\" he said when asked to
\ncomment on the disappointment expressed by the donor institutions
\nin a letter sent to the Coordinating Minister for Economy,
\nFinance and Industry Ginandjar Kartasasmita as reported by Kompas
\ndaily on Monday.<\/p>\n
The IMF and the World Bank have withheld aid disbursement for
\nIndonesia until the government resolves the Bank Bali scandal
\nsatisfactorily.<\/p>\n
Yudono said previously that the complete PwC audit report --
\nwhich contains information on activity in the bank accounts of
\npeople allegedly involved in the scandal -- could not be
\ndisclosed on account of the law governing BPK and the banking
\nsecrecy law.<\/p>\n
BPK only furnished the full PwC report to the police. The
\npolice have said they would treat the report as mere input
\nbecause its methodology was doubtful.<\/p>\n
Asked to comment on the letter reportedly sent to Ginandjar,
\nYudono appeared skeptical. \"Where's the letter? Let's read it
\ntogether,\" he said.<\/p>\n
When asked if he would disclose the PwC audit report if the
\nIMF and World Bank letter did exist, he declined to answer. \"You
\nhave disturbed my right to go home,\" he said.<\/p>\n
The government's determination not to disclose the full audit
\nreport has fanned suspicions of a cover-up orchestrated by
\nHabibie's inner circle.<\/p>\n
The scandal revolves around the transfer of Rp 546 billion
\nfrom the bank to PT Era Giat Prima (EGP) as a commission for
\nhelping the bank to recoup some Rp 904 billion in interbank loans
\nto closed banks.<\/p>\n
The government said Bank Bali should have not used the
\nservices of EGP because the loans were guaranteed by the
\ngovernment under its blanket guarantee program.<\/p>\n
Meanwhile, Bank Indonesia deputy governor Subarjo Joyosumarto
\nsaid on Monday the IMF had sent a representative to Jakarta to
\ndiscuss the bank restructuring program. (rei\/ylt)<\/p>",
