Romli highlighted the ongoing controversy surrounding the\ncalculation of state losses in corruption cases, which has led to\nvarious conflicting interpretations.<\/p>\n<p>Speaking during a public hearing with the DPR\u2019s Legislation Committee\n(Baleg) in Jakarta on Monday, Romli noted that the position of the Audit\nBoard of Indonesia (BPK) as the sole authorised state institution for\ncalculating losses is currently being ignored. He expressed confusion\nover why prosecutors and judges are now attempting to perform these\ntechnical calculations, questioning how legal professionals are expected\nto master accounting mathematics.<\/p>\n<p>During the meeting, Romli referenced the legal issues involving\nformer Minister of Education, Nadiem Makarim, and former Minister of\nTrade, Thomas Trikasih Lembong. He remarked that the current state of\nIndonesian legislation is becoming increasingly unstable, noting that\nthe bureaucracy is now hesitant to make decisions for fear of facing\nsimilar legal repercussions.<\/p>\n<p>Consequently, Romli is pushing for a total revision of the\nAnti-Corruption Law and the swift passage of the Asset Forfeiture Bill.\nHe suggested that following the United Nations Convention Against\nCorruption (UNCAC), which Indonesia has ratified, the element of \u2018state\nloss\u2019 should be removed from the primary definition of corruption\noffences. He argued that eliminating this element would end disputes\nover which authority is responsible for calculating losses.<\/p>\n<p>Furthermore, Romli emphasised that strengthening international\ncooperation for asset recovery is more critical than pursuing officials\nwho may be unaware of the legal complexities.
