        "content": "<p>Jakarta, CNBC Indonesia - Indonesian President Prabowo Subianto, in a\nplenary session of the DPR RI on Wednesday, 20 May 2026, announced that\nhe would establish a Special Export State-Owned Enterprise (BUMN Ekspor)\nfor commodities. With this body, the export activities of coal, palm\noil, and other mineral exporters will be entirely conducted by this\nSpecial Export SOE. \u2018To achieve the nation\u2019s objectives, today the\ngovernment I lead has issued a PP on the governance of the export of\nnatural resource assets. The issuance of this PP is a strategic step to\nstrengthen the governance of our natural resource commodity exports,\u2019\nPrabowo said, on Wednesday (10 May 2026).<\/p>\n<p>Prabowo disclosed that the sale of all Indonesia\u2019s natural resource\noutputs, including palm oil, coal, and ferrous alloys, must be conducted\nthrough the Special Export SOE. \u2018Sales must be conducted through the\nstate-owned entity designated by the Government of the Republic of\nIndonesia as the sole exporter. In other words, every export product\nwill be channelled by the government-designated Export SOE to the\nbusiness operators managing those activities,\u2019 Prabowo explained.<\/p>\n<p>Prabowo stated that the aim of establishing the Special Export SOE\ncould be described as a marketing facility, thereby strengthening\noversight and monitoring to combat practices of under invoicing,\ntransfer pricing, and the leakage of export proceeds (Devisa Hasil\nEkspor). \u2018This policy will optimise tax revenue and state revenue from\nthe management of our natural resources; with this policy we hope that\nour revenues can be on a level with Mexico, the Philippines, and our\nneighbouring countries,\u2019 he said. \u2018We do not want our revenues to be the\nlowest because we are not brave enough to manage what belongs to us, the\nnation\u2019s own assets,\u2019 he insisted.<\/p>\n<p>Scheme of the PP on the Governance of Export of Natural Resource\nCommodities (Prabowo\u2019s briefing to the DPR)<\/p>\n<p>Phase I: (Export processing) From 1 June to 31 August 2026<\/p>\n<ul>\n<li><p>Companies must transfer their transactions to the SOE<\/p><\/li>\n<li><p>The SOE must transact and contract with all foreign\nbuyers<\/p><\/li>\n<\/ul>\n<p>Phase II: (Export processing) From 1 September 2026<\/p>\n<ul>\n<li><p>Transactions and contracts with foreign buyers -&gt; entirely\nthrough the SOE<\/p><\/li>\n<li><p>Responsibility and authority of export managers -&gt;\nSOE<\/p><\/li>\n<\/ul>\n<p>The following is the full draft of the regulation on the Special\nExport SOE regarding \u201cGovernance of Export of Strategic Natural Resource\nCommodities Through a State-Owned Enterprise\u201d.<\/p>\n<p>CHAPTER I<\/p>\n<p>GENERAL PROVISIONS<\/p>\n<p>Article 1<\/p>\n<p>In this Government Regulation, the terms mean:<\/p>\n<ol type=\"1\">\n<li><p>Export means the activity of taking goods out of Indonesia\u2019s\ncustoms area.<\/p><\/li>\n<li><p>Strategic Natural Resource Commodities are natural resource\ncommodities designated by the Government considering national interest,\neconomic stability, domestic needs, and\/or the management of\nstrategically important natural resources.<\/p><\/li>\n<li><p>A State-Owned Enterprise (BUMN) is an entity that meets at least\none of the following:<\/p>\n<ol type=\"a\">\n<li><p>all or most of its capital is owned by the Republic of Indonesia\nthrough direct participation; or<\/p><\/li>\n<li><p>there are privileges possessed by the Republic of\nIndonesia.<\/p><\/li>\n<\/ol><\/li>\n<li><p>An Export SOE (BUMN Ekspor) is a BUMN that has been assigned a\nspecific mandate by the Government to carry out export activities of\nStrategic Natural Resource Commodities.<\/p><\/li>\n<\/ol>\n<p>CHAPTER II<\/p>\n<p>DESIGNATION OF STRATEGIC NATURAL RESOURCE COMMODITIES<\/p>\n<p>Article 2<\/p>\n<ol type=\"1\">\n<li>The Strategic Natural Resource Commodities under export governance\ninclude:<\/li>\n<\/ol>\n<ol type=\"a\">\n<li><p>coal;<\/p><\/li>\n<li><p>palm oil; and<\/p><\/li>\n<li><p>other Strategic Natural Resource Commodities.<\/p><\/li>\n<\/ol>\n<ol start=\"2\" type=\"1\">\n<li>The Government may change the Strategic Natural Resource Commodities\nas referred to in paragraph (1) letters a and b, and designate other\nStrategic Natural Resource Commodities as referred to in paragraph (1)\nletter c, through a coordination meeting chaired by:<\/li>\n<\/ol>\n<ol type=\"a\">\n<li><p>the minister responsible for synchronisation, coordination and\ncontrol of ministerial affairs in economic governance; or<\/p><\/li>\n<li><p>the minister responsible for synchronisation, coordination and\ncontrol of affairs in the field of food,<\/p><\/li>\n<\/ol>\n<p>attended by ministers\/head of non-ministerial government\nagencies.<\/p>\n<ol start=\"3\" type=\"1\">\n<li>The designation of changes to Strategic Natural Resource Commodities\nas referred to in paragraph (2) and the designation of other strategic\ncommodities as referred to in paragraph (2) are regulated in a\nministerial regulation dealing with trade matters.<\/li>\n<\/ol>\n<p>CHAPTER III<\/p>\n<p>EXPORT GOVERNANCE<\/p>\n<p>Article 3<\/p>\n<ol type=\"1\">\n<li><p>The Strategic Natural Resource Commodities referred to in Article\n2 may only be exported by an Export SOE.<\/p><\/li>\n<li><p>The Export SOE referred to in paragraph (1) is designated in\naccordance with the provisions of the laws and regulations in the field\nof BUMN.<\/p><\/li>\n<\/ol>\n<p>Article 4<\/p>\n<ol type=\"1\">\n<li>The governance of Export of Strategic Natural Resource Commodities\nas referred to in Article 2 may be carried out through:<\/li>\n<\/ol>\n<ol type=\"a\">\n<li><p>export control; and\/or<\/p><\/li>\n<li><p>other mechanisms in accordance with the provisions of the\nlaw.<\/p><\/li>\n<\/ol>\n<ol start=\"2\" type=\"1\">\n<li>Further provisions regarding the governance of Export of Strategic\nNatural Resource Commodities as referred to in paragraph (1) shall be\nset by each relevant minister\/head of non-ministerial government\nagencies in accordance with their authority.<\/li>\n<\/ol>\n<p>CHAPTER IV<\/p>\n<p>DEVELOPMENT AND SUPERVISION<\/p>\n<p>Article 5<\/p>\n<p>Development and supervision of the implementation of governance of\nExport of Strategic Natural Resource Commodities shall be carried out by\nthe respective minister\/head of the relevant non-ministerial government\nagency in accordance with their authority.<\/p>\n<p>CHAPTER V<\/p>\n<p>TRANSITIONAL PROVISIONS<\/p>\n<p>Article 6<\/p>\n<p>Upon entry into force of this Government Regulation:<\/p>\n<ol type=\"a\">\n<li><p>Export of Strategic Natural Resource Commodities as referred to\nin Article 2 may only be conducted through the Export SOE until 31\nDecember 2026.<\/p><\/li>\n<li><p>Exports of Strategic Natural Resource Commodities as referred to\nin Article 2 after 31 December 2026 may only be conducted by the Export\nSOE.<\/p><\/li>\n<li><p>If the implementation of Export of Strategic Natural Resource\nCommodities as referred to in Article 2 has been fully transferred to\nthe Export SOE before 31 December<\/p><\/li>\n<\/ol>",
