Police urged to continue probe on malpractice cases<\/p>\n

Eighteen families grouped under the Community of Victims of the
\nHealth System came to the Jakarta Police Headquarters and
\nNational Police on Monday, calling on the police to conduct a
\nserious investigation into malpractice allegations.<\/p>\n
\"There have been at least 25 complaints filed since February
\nwith the police regarding malpractice,\" said Iskandar Sitorus of
\nthe Legal Aid Institute for Health, who accompanied the families.<\/p>\n
From the 25 complaints, 20 of them were filed with the Jakarta
\nPolice. \"But no case files have been submitted to the
\nprosecutor's office to date,\" he said.<\/p>\n
The Jakarta Police detectives chief Sr. Comr. Mathius
\nSalempang said the police had been facing difficulties in
\ncompleting the investigation on malpractice cases.<\/p>\n
\"One of the problems is some of the patients who filed
\ncomplaints refused to be questioned. I don't know their reasons.
\nWe can't start an investigation without statements from them,\" he
\nsaid.<\/p>\n
Salempang explained that before the police named any suspects,
\nthey had to determine whether any mistakes were made in the
\nmedical procedures carried out by the doctors.<\/p>\n
\"We rely on the decisions made by the Indonesian Doctors
\nAssociation (IDI)'s ethics board, which holds meetings to discuss
\ncases related to doctors' code of ethics every Thursday,\" he
\nsaid.<\/p>\n
\"We have sent letters to the board requesting them to include
\nour cases in the meeting and they have agreed to examine them.\"<\/p>\n
Separately, IDI chairman Farid Anfasa Moeloek said every
\npatient carried an inherent risk when he or she suffered from a
\ndisease.<\/p>\n
\"The risk could be minor like that of influenza. But in other
\ncases like a tumor in the uterus, the risk is greater,\" he said.<\/p>\n
He explained that doctors would strive to do their best in
\nkeeping with medical procedures.<\/p>\n
\"If he or she had gone through all the procedures correctly,
\nbut the patient still had not recovered, we cannot accuse the
\ndoctor of malpractice,\" he argued.<\/p>\n
Moeloek claimed that in the last three years, the ethics board
\nhas found that 80 percent of the doctors reported to the board
\nwere not guilty of malpractice.<\/p>\n
The board imposed sanctions to the remaining 20 percent, who
\nwere found guilty of not sticking to procedures. The sanctions
\nincluding revoking their medical licenses.<\/p>\n
Moeloek said the bill on medical doctors would scrap the
\nexisting ethics board and replace it with the medical doctors
\ndisciplinary council that would comprise of, among others,
\ndoctors and legal experts.<\/p>\n
\"The board will be more independent, it will work outside the
\nIDI,\" he said. \"I think it will be fair.\"<\/p>\n
He acknowledged that in general there was still a lot of room
\nfor improvement in medical services in Indonesia.<\/p>\n
