        "content": "<p>Police criticized over students' VCD<\/p>\n<p>Yuli Tri Suwarni, The Jakarta Post, Bandung<\/p>\n<p>Lawyers have criticized the decision of Bandung police to name<br>\nstudents AH and NN as suspects in the case of a porn VCD starring<br>\nthe two students, saying that the decision was groundless.<\/p>\n<p>Criminal law expert at the Padjadjaran University in Bandung<br>\nPontang Moerad said last week that the police had fabricated<br>\nmatters.<\/p>\n<p>\"Our Criminal Code (KUHP) prohibits three things about sexual<br>\nrelations: adultery, under-aged sex and sex with violence, which<br>\nwe know as rape. The two students are adults who had sexual<br>\nrelations with mutual content. This is a question of morals which<br>\nis not covered by the KUHP,\" Pontang told The Jakarta Post on the<br>\nweekend.<\/p>\n<p>He regretted the reckless move by the police to question<br>\npeople (the two students) without legal justification.<\/p>\n<p>\"What have they (the two students) done? They filmed<br>\nthemselves for their personal viewing. They had never intended to<br>\nsell or circulate copies of the film. The two are really victims<br>\nwho deserve compensation for the unwanted circulation of their<br>\nfilm,\" said Pontang.<\/p>\n<p>\"The police should stop the questioning of the two students<br>\n(as suspects) before they are embarrassed.\"<\/p>\n<p>Chief of Bandung police detectives Adj. Sr. Comr. Siswandi<br>\ntold the media on Friday that the two students had officially<br>\nbeen named as suspects on Thursday, Oct. 24.<\/p>\n<p>\"And legal proceedings were taken over by the West Java police<br>\nfrom that point,\" he said in Bandung.<\/p>\n<p>The suspects, AH, a (male) student of the National Institute<br>\nof Technology (Itenas) and NN a student of the Padjadjaran<br>\nUniversity were both summoned on Thursday. But only AH fulfilled<br>\nthe police summons, while NN failed to show up.<\/p>\n<p>Accompanied by his lawyer Atilla Graziani, AH was asked 30<br>\nquestions by the interrogators.<\/p>\n<p>According to chief of West Java police detectives Sr. Comr.<br>\nHendra Sukmana the naming of AH and NN as suspects was based on<br>\nWest Java Police chief Insp. Gen. Sudirman Ail's statement that<br>\nthe two had committed immoral acts.<\/p>\n<p>The story began when AH and NN celebrated the 23rd month of<br>\ntheir relationship in a hotel in Jakarta. Using a handycam<br>\nbelonging to a friend they filmed themselves having sex and AH<br>\nasked a friend to transfer the footage from handycam cassette to<br>\nVCD.<\/p>\n<p>To the couple's shock, copies of the VCD began circulating<br>\nwithout their permission. The film has been available in local<br>\nillegal markets since August.<\/p>\n<p>Nursyahbani Katjasungkana, a Jakarta-based lawyer, said in a<br>\nseparate interview that the police had overacted in this case.<\/p>\n<p>\"The police may use Article 282 of the Criminal Code on<br>\nimmorality. The police should have proven that the two were<br>\nguilty of displaying, circulating or distributing pornographic<br>\nmaterial to the public. If they (the police) cannot prove this<br>\nthey cannot name the two as suspects,\" said Nursyahbani, who is<br>\nalso a rights activist.<\/p>\n<p>She said that there must have been misinterpretation of the<br>\narticle.<\/p>\n<p>Anyone found guilty of violating Article 282 of the Criminal<br>\nCode is subject to a maximum 18-month jail term or a fine of Rp<br>\n4,500.<\/p>\n<p>Sr. Comr. Hendra told reporters in Bandung that the two had<br>\nviolated the Law on Film, No. 8\/1972. \"They made a film, didn't<br>\nthey?\"<\/p>\n<p>Chief of West Java detectives for general crime Comr. Guntur<br>\nLaupe said that the two had also violated the Supreme Court's<br>\nruling No. 666\/1984, which says that a sexual relationship<br>\nbetween an unmarried couple is an offense.<\/p>\n<p>The ruling has been effective since Feb. 23, 1985.<\/p>",
