The Indonesian Curators and Administrators Association (Perkapi) is\npushing for the Curator Profession Bill to be included in the House of\nRepresentatives\u2019 priority national legislation programme\n(Prolegnas).<\/p>\n
The proposal was put forward by Perkapi during a public hearing\n(RDPU) at Commission XIII of the DPR on Tuesday (15\/6). Perkapi\nconsiders the bill important to avoid a legal vacuum and overlapping\nrules with Law Number 37 of 2004 on Bankruptcy and Suspension of Debt\nPayment Obligations (PKPU).<\/p>\n
\u201cWe propose that it would be best for this to be made a priority law\nand for it to become a lex specialis,\u201d said Asri Munde, a member of\nPerkapi\u2019s Advisory Board, during the hearing.<\/p>\n
According to Asri, the Curator Profession Bill must serve as a lex\nspecialis to the Bankruptcy Law. This is because, although the\nprofession has existed since 1998, there has never been a provision\nregulating it.<\/p>\n
To date, the legal basis for the curator profession only refers to\ngovernment regulations issued through the Minister of Law.<\/p>\n
\u201cCurators have existed since \u201998, but there has never been an\norganisation or law providing an umbrella for them. Everything is based\non government regulations,\u201d he said.<\/p>\n
Beyond a legal umbrella, Perkapi, according to Asri, is also pushing\nfor protection of the curator profession within the bill. This is\nbecause, he said, curators remain vulnerable to criminalisation by\ninterested parties.<\/p>\n
In the economic sector, a curator is a professional appointed by the\ncommercial court to manage, secure, and settle the assets of a debtor\ndeclared bankrupt.<\/p>\n
\u201cThe most important input relates to ensuring that this profession\nbill does not simply regulate matters, but rather how to ensure curators\nare not easily criminalised,\u201d he said.<\/p>\n
Unlike the Bankruptcy Law, which regulates material and formal\naspects, Asri believes the Curator Bill will regulate professional\nstandards, oversight, duties, and responsibilities.<\/p>\n
