Setiogi, The Jakarta Post, Jakarta<\/p>\n<p>Kartika, 25, a new mother, said he was advised to deliver her son<br>\nby caesarean section, which she eventually agreed to.<\/p>\n<p>\"My obstetrician told me I had to do it because my baby would<br>\nbe to large to deliver naturally,\" she said.<\/p>\n<p>Kartika said her son only weighed 2.3 kilograms at birth, and<br>\nshe continues to suffer postsurgical pain. Another obstetrician<br>\nshe consulted said she could have delivered her baby naturally.<\/p>\n<p>Kartika is just one example of how patients are not well<br>\nprotected against medical malpractice.<\/p>\n<p>Budi Sampurno, an expert on medical law, said medical<br>\nmalpractice included misdiagnoses, mistreatment, trouble under<br>\nanesthesia, postsurgical complications and visible negligence.<\/p>\n<p>In a speech on Saturday at the Indo Surgitex 2003, Budi said<br>\nthat ethically surgeons should follow the principle of non<br>\nmaleficence primum non nocere, or surgery should only take place<br>\nif non-surgical solutions are impossible.<\/p>\n<p>\"Surgery is invasive and requires a certain competency on the<br>\npart of the patient to make the decision and to understand the<br>\nsigned consent form.<\/p>\n<p>\"The aim of signing a consent form is to make sure that the<br>\npatient really understands the consequences and risks of<br>\nundergoing surgery, not just to deliver information and leave the<br>\npatient with questions,\" Budi said.<\/p>\n<p>Indonesia has yet to pass a law regulating the medical<br>\nprofession. As a result, doctors accused of malpractice can only<br>\nbe charged under the Criminal Code.<\/p>\n<p>As an example of how weak the protection of patients' rights<br>\nis, Budi pointed to a court case in Jakarta that eventually was<br>\nwon by the hospital named in the suit.<\/p>\n<p>Budi said if malpractice occurs during surgery in a hospital,<br>\nthe surgeon should not be the only party held responsible.<\/p>\n<p>\"This should be the responsibility of the hospital management<br>\nas the malpractice occurs in the hospital as an institution,\" he<br>\nsaid.<\/p>",
