        "content": "<p>Officials powerless against bylaw violators<\/p>\n<p>Multa Fidrus, The Jakarta Post, Tangerang<\/p>\n<p>The bylaw stipulates clearly that the riverbanks, which are<br>\nincluded as green areas, must be free from buildings. The fact<br>\nshows that two fancy restaurants are standing on the Cisadane<br>\nriverbank.<\/p>\n<p>However, the Tangerang municipal administration turns a blind<br>\neye to the reality.<\/p>\n<p>The first restaurant is the Istana Nelayan, located on a<br>\n4,500-square-meter lot in Kebon Nanas area and adjacent to the<br>\nJakarta-Merak toll road on 19.5 kilometer mark heading to the<br>\ncapital. The second is the newly opened Selera Kuring restaurant<br>\non Jl. Perintis Kemerdekaan in Tangerang.<\/p>\n<p>The Istana Nelayan general manager, Sandi Kumara, denied that<br>\nthe restaurant's presence has violated the bylaw.<\/p>\n<p>\"We rent the area on the riverbank from the Tangerang<br>\nIrrigation Agency Office. We built the restaurant 30 meters away<br>\nfrom the riverbank so we don't break the border line. We have<br>\nalso grown plants to provide good views,\" he told The Jakarta<br>\nPost.<\/p>\n<p>He even said that the restaurant has extended the contract on<br>\nthe land for the second year. Each year the restaurant must pay<br>\nRp 1,125,000 to the agency office.<\/p>\n<p>The Tangerang administration deputy on development control and<br>\nsupervision, Harry Mulya Zain, admitted that both restaurants<br>\npresence has violated the bylaw but he could not take any<br>\nmeasures.<\/p>\n<p>\"I have no authority,\" he claimed.<\/p>\n<p>Harry explained that his authority was limited only to control<br>\nand supervise the development activities financed by the<br>\nmunicipal administration.<\/p>\n<p>He pointed his finger to the Permit and Capital Investment<br>\nAgency, Public Works Agency, Irrigation Agency and Tourism Agency<br>\nas the ones who were supposed to be responsible for issuing the<br>\npermits to both restaurants.<\/p>\n<p>The Public Policy Study Institution (LKP) director, Ibnu<br>\nJandi, said the presence of both restaurants has violated Article<br>\n4 Bylaw No. 6\/1994 on riverbank border line. But none of the<br>\nadministration officials have taken stern measures although the<br>\ninstitution has protested previously.<\/p>\n<p>He said the bylaw, which is also strengthened by the Ministry<br>\nof Home Affairs regulation No. 63\/PRT\/1993, stipulated that the<br>\nviolator must be sentenced to three-month prison term and the<br>\nbuilding must be demolished.<\/p>\n<p>\"The two restaurants presence at the riverbanks can create<br>\ndiscrimination as the Cisadane riverbanks have interesting areas<br>\nfor business,\" Jandi told the Post.<\/p>\n<p>The Solidarity for Indonesian Community (Somasi), also focuses<br>\nits study on public policy, said the administration has broken<br>\nits own bylaw by issuing permits for both restaurants.<\/p>\n<p>\"The administration officials are paid to enforce the law, but<br>\nthey did just the opposite. How can we trust that there is law<br>\nenforcement here?\" Somasi chairman, Icung Noor, said.<\/p>",
