Officials powerless against bylaw violators<\/p>\n

The bylaw stipulates clearly that the riverbanks, which are
\nincluded as green areas, must be free from buildings. The fact
\nshows that two fancy restaurants are standing on the Cisadane
\nriverbank.<\/p>\n
However, the Tangerang municipal administration turns a blind
\neye to the reality.<\/p>\n
The first restaurant is the Istana Nelayan, located on a
\n4,500-square-meter lot in Kebon Nanas area and adjacent to the
\nJakarta-Merak toll road on 19.5 kilometer mark heading to the
\ncapital. The second is the newly opened Selera Kuring restaurant
\non Jl. Perintis Kemerdekaan in Tangerang.<\/p>\n
The Istana Nelayan general manager, Sandi Kumara, denied that
\nthe restaurant's presence has violated the bylaw.<\/p>\n
\"We rent the area on the riverbank from the Tangerang
\nIrrigation Agency Office. We built the restaurant 30 meters away
\nfrom the riverbank so we don't break the border line. We have
\nalso grown plants to provide good views,\" he told The Jakarta
\nPost.<\/p>\n
He even said that the restaurant has extended the contract on
\nthe land for the second year. Each year the restaurant must pay
\nRp 1,125,000 to the agency office.<\/p>\n
The Tangerang administration deputy on development control and
\nsupervision, Harry Mulya Zain, admitted that both restaurants
\npresence has violated the bylaw but he could not take any
\nmeasures.<\/p>\n
\"I have no authority,\" he claimed.<\/p>\n
Harry explained that his authority was limited only to control
\nand supervise the development activities financed by the
\nmunicipal administration.<\/p>\n
He pointed his finger to the Permit and Capital Investment
\nAgency, Public Works Agency, Irrigation Agency and Tourism Agency
\nas the ones who were supposed to be responsible for issuing the
\npermits to both restaurants.<\/p>\n
The Public Policy Study Institution (LKP) director, Ibnu
\nJandi, said the presence of both restaurants has violated Article
\n4 Bylaw No. 6\/1994 on riverbank border line. But none of the
\nadministration officials have taken stern measures although the
\ninstitution has protested previously.<\/p>\n
He said the bylaw, which is also strengthened by the Ministry
\nof Home Affairs regulation No. 63\/PRT\/1993, stipulated that the
\nviolator must be sentenced to three-month prison term and the
\nbuilding must be demolished.<\/p>\n
\"The two restaurants presence at the riverbanks can create
\ndiscrimination as the Cisadane riverbanks have interesting areas
\nfor business,\" Jandi told the Post.<\/p>\n
The Solidarity for Indonesian Community (Somasi), also focuses
\nits study on public policy, said the administration has broken
\nits own bylaw by issuing permits for both restaurants.<\/p>\n
\"The administration officials are paid to enforce the law, but
\nthey did just the opposite. How can we trust that there is law
\nenforcement here?\" Somasi chairman, Icung Noor, said.<\/p>",
