        "content": "<p>The former Deputy Minister of Manpower of the Republic of Indonesia,\nImmanuel Ebeneber, known as Noel Ebenezer, has been sentenced to five\nyears in prison and a fine of Rp250 million, with a subsidiary of 90\ndays in prison.<\/p>\n<p>Prosecutors from the Corruption Eradication Commission (KPK) stated\nthat Noel was proven to have received funds totalling Rp4.4 billion,\nconsisting of a Rp1 billion bribe, Rp3.4 billion in gratifications, and\na navy blue Ducati Scrambler motorcycle valued at Rp600 million.<\/p>\n<p>\u201cSentencing the defendant Immanuel Ebenezer Gerungan to five years of\nimprisonment and a fine of Rp250 million, subsidiary to 90 days of\nimprisonment,\u201d the KPK prosecutor stated while reading the indictment at\nthe Corruption Crime Court (Tipikor) of the Central Jakarta District\nCourt on Monday night.<\/p>\n<p>The prosecution also requested that the panel of judges order Noel to\npay restitution amounting to Rp4.4 billion. However, as Noel has already\nreturned a portion of the funds amounting to Rp3 billion, the remaining\nrestitution to be paid is Rp1.43 billion. Should Noel\u2019s assets prove\ninsufficient to cover the restitution within one month after the court\u2019s\ndecision becomes legally binding, the amount will be replaced by an\nadditional two-year prison sentence.<\/p>\n<p>Based on the legal facts presented during the trial, prosecutors\nstated that Noel was proven to have violated Article 12 letter b in\nconjunction with Article 18 of the Law on Eradication of Corruption\nCrimes, in conjunction with Article 20 letter C and Article 127\nparagraph 1 of the Criminal Code (KUHP).<\/p>\n<p>In delivering the sentencing demand, the prosecutors highlighted\nseveral aggravating and mitigating factors. The aggravating factor is\nthat Noel\u2019s actions do not support the government\u2019s programme to achieve\na government free from Corruption, Collusion, and Nepotism (KKN).\nConversely, the mitigating factors include Noel\u2019s admission of his\nactions, the partial return of the funds, his lack of prior criminal\nrecord, and his polite conduct during the trial.<\/p>\n<p>In addition to Noel, several other defendants from the Ministry of\nManpower have also been found guilty and sentenced to prison in\nconnection with this bribery and gratification case.<\/p>",
