        "content": "<p>In addition to a prison sentence of 18 years and a fine of Rp1\nbillion subsidiary to 190 days\u2019 imprisonment, prosecutors want the\nCorruption Court panel at the Central Jakarta District Court to order\nNadiem Anwar Makarim to pay restitution amounting to Rp809,597,125,000\n(Rp809.5 billion) and Rp4,871,469,603,758 (Rp4.8 trillion). According to\nthe prosecutors, the former Minister of Education and Culture during\nPresident Joko Widodo\u2019s administration has been proven to have caused\nlosses to state finances in the procurement of Chromebook laptops and\nChrome Device Management (CDM) for the 2020-2022 fiscal years. \u201cImpose\nan additional criminal penalty on the Defendant Nadiem Anwar Makarim to\npay restitution of Rp809.59 billion and Rp4,871,469,603,758, which\nconstitutes the Defendant\u2019s assets disproportionate to his lawful income\nor suspected to originate from corruption,\u201d stated Prosecutor Roy Riady\nwhile reading the criminal indictment at the Jakarta Corruption Court on\nWednesday (13\/5). In total, the restitution demanded from Nadiem amounts\nto Rp5,681,066,728,758 (Rp5.6 trillion). If the restitution is not paid,\nit will be substituted with 9 years\u2019 imprisonment. Nadiem, along with\nspecial staff member Jurist Tan (fugitive) and consultant Ibrahim Arief\nalias Ibam, is accused of directing Mulyatsyah and Sri Wahyuningsih, as\nchair and deputy chair of the technical team for Chromebook laptops, to\nsupport the education digitalisation programme. The selection of\nChromebooks, according to the prosecutors, was not based on an\nidentification of the needs of primary and secondary education in\nIndonesia. \u201cThus, it resulted in a failure of utilisation, particularly\nin 3T (disadvantaged, frontier, outermost) areas, constituting an\nunlawful act and a betrayal of the constitution,\u201d the prosecutor stated.\nNadiem is being prosecuted for corruption offences causing state\nfinancial losses of Rp2.18 trillion related to the education\ndigitalisation programme involving the procurement of Chromebook laptops\nand CDM within the Ministry of Education, Culture, Research, and\nTechnology for 2020-2022. The corruption is alleged to have occurred,\namong other things, by implementing the procurement of information and\ncommunication technology-based learning facilities in the form of\nChromebook laptops and CDM for the 2020, 2021, and 2022 fiscal years not\nin accordance with the procurement planning and principles of\nprocurement. Nadiem is said to have committed the offence jointly with\nother defendants in separate trials, namely Ibrahim Arief, Mulyatsyah,\nSri Wahyuningsih, and Jurist Tan, who remains at large. The detailed\nstate financial losses include Rp1.56 trillion related to the education\ndigitalisation programme at the Ministry of Education, Culture,\nResearch, and Technology, as well as US$44.05 million or equivalent to\nRp621.39 billion due to the procurement of unnecessary and unbeneficial\nCDM. Through these actions, Nadiem is suspected of receiving Rp809.59\nbillion from PT Aplikasi Karya Anak Bangsa (PT AKAB) via PT Gojek\nIndonesia. It is stated that the majority of PT AKAB\u2019s funding sources\ncome from Google Asia Pacific investments worth US$786.99 million.\nMeanwhile, for Ibam, Mulyatsyah, and Sri Wahyuningsih, the Jakarta\nCorruption Court panel has already convicted the Defendants. Ibam, as a\nconsultant at the Ministry of Education, Culture, Research, and\nTechnology, was sentenced to 4 years\u2019 imprisonment and a fine of Rp500\nmillion subsidiary to 120 days\u2019 imprisonment. The ruling against Ibam\nwas marked by a dissenting opinion from two member judges, Eryusman and\nAndi Saputra. Meanwhile, Mulyatsyah, as the former Director of Secondary\nEducation at the Ministry of Education, Culture, Research, and\nTechnology in 2020, was sentenced to 4.5 years\u2019 imprisonment and a fine\nof Rp500 million subsidiary to 120 days.
