Former Minister of Education, Culture, Research, and Technology\nduring President Joko Widodo\u2019s administration, Nadiem Anwar Makarim, has\nbeen demanded to face 18 years\u2019 imprisonment and a fine of Rp1 billion\nsubsidiary to 190 days\u2019 imprisonment.<\/p>\n
According to prosecutors, based on the legal facts revealed in the\ntrial, Nadiem has been proven to have caused losses to state finances in\nthe procurement of Chromebook laptops and Chrome Device Management (CDM)\nfor the 2020-2022 fiscal years.<\/p>\n
\u201cTherefore, imposing a sentence on the defendant Nadiem Anwar Makarim\nof 18 years\u2019 imprisonment,\u201d stated Prosecutor Roy Riady while reading\nout the indictment at the Corruption Court (Tipikor) at the Central\nJakarta District Court on Wednesday (13\/5).<\/p>\n
In addition, prosecutors demanded that the panel of judges impose\nadditional penalties on Nadiem in the form of repayment of\nRp809,597,125,000 (Rp809.5 billion) and Rp4,871,469,603,758 (Rp4.8\ntrillion) \u2013 which constitutes the defendant\u2019s assets disproportionate to\nlegitimate income or suspected to originate from corruption offences. If\nthe repayment is not made, it will be replaced with 9 years\u2019\nimprisonment.<\/p>\n
Nadiem, along with special staff Jurist Tan (fugitive) and Ibrahim\nArief alias Ibam (consultant), is said to have directed Mulyatsyah and\nSri Wahyuningsih, as chair and deputy chair of the technical team for\nChromebook laptops, to support the education digitalisation\nprogramme.<\/p>\n
The designation of Chromebooks, according to prosecutors, was not\nbased on an identification of basic and secondary education needs in\nIndonesia.<\/p>\n
\u201cThus, it resulted in a failure of utilisation, especially in 3T\nareas (disadvantaged, frontier, outermost), which is an unlawful act and\na betrayal of the constitution,\u201d stated the prosecutor.<\/p>\n
In imposing the criminal demand, the prosecutors revealed several\naggravating and mitigating circumstances.<\/p>\n
The aggravating factors include that Nadiem\u2019s actions do not support\nthe government\u2019s programme for a corruption, collusion, and nepotism\n(KKN)-free state administration.<\/p>\n
The criminal act committed has resulted in the quality of education\nfor Indonesian children being hindered. Furthermore, Nadiem\u2019s actions\ncaused enormous state losses.<\/p>\n
In the implementation of the Chromebook ICT procurement, to gain\npersonal benefits, Nadiem is said to have ignored the quality of early\nand secondary education. Nadiem is also accused of being evasive in\nproviding statements during the trial.<\/p>\n
\u201cThe mitigating factors for the defendant are that he has never been\nconvicted before,\u201d stated the prosecutor.<\/p>\n
Nadiem is being prosecuted for corruption offences causing state\nfinancial losses of Rp2.18 trillion related to the education\ndigitalisation programme involving the procurement of Chromebook laptops\nand CDM within the Ministry of Education, Culture, Research, and\nTechnology for the years 2020-2022.<\/p>\n
The corruption is alleged to have been committed, among others, by\ncarrying out the procurement of information and communication\ntechnology-based learning facilities in the form of Chromebook laptops\nand CDM for the fiscal years 2020, 2021, and 2022 not in accordance with\nthe procurement planning and principles of procurement.<\/p>\n
Nadiem is said to have committed the offence jointly with other\ndefendants in separate trials, namely Ibrahim Arief, Mulyatsyah, Sri\nWahyuningsih, as well as Jurist Tan who remains at large.<\/p>\n
The detailed state financial losses include Rp1.56 trillion related\nto the education digitalisation programme at the Ministry of Education,\nCulture, Research, and Technology, as well as US$44.05 million or\nequivalent to Rp621.39 billion due to unnecessary and unbeneficial CDM\nprocurement.<\/p>\n
Through these actions, Nadiem is alleged to have received Rp809.59\nbillion originating from PT Aplikasi Karya Anak Bangsa (PT AKAB) via PT\nGojek Indonesia. It is stated that most of PT AKAB\u2019s funding sources\ncome from Google Asia Pacific investments worth US$786.99 million.<\/p>\n
Meanwhile, for Ibam, Mulyatsyah, and Sri Wahyuningsih, the Tipikor\nCourt panel in Jakarta has already convicted the defendants.<\/p>\n
Ibam, as a consultant at the Ministry of Education, Culture,\nResearch, and Technology, was sentenced to 4 years\u2019 imprisonment and a\nfine of Rp500 million subsidiary to 120 days\u2019 imprisonment.<\/p>\n
The decision against Ibam was marked by a dissenting opinion from two\nmember judges, Eryusman and Andi Saputra.<\/p>\n
Meanwhile, Mulyatsyah, as former Director of Secondary Education at\nthe Ministry in 2020, was sentenced to 4.5 years\u2019 imprisonment and a\nfine of Rp500 million subsidiary to 120 days.<\/p>\n
He was also imposed with an additional penalty of repayment of Rp2.28\nbillion subsidiary to 2 years\u2019 imprisonment.<\/p>\n
Sri Wahyuningsih, as former Director of Primary Schools at the\nDirectorate General of Early Childhood Education, Basic Education, and\nSecondary Education in 2020-2021, was sentenced to 4 years\u2019 imprisonment\nand a fine of Rp500 million subsidiary to 120 days\u2019 custody.<\/p>\n
