N. Jakarta plot dispute nets Navy<\/p>\n
JAKARTA (JP): Disputing parties of a tract of land in North
\nJakarta affirmed their positions before a court yesterday.<\/p>\n
Representatives from the government told the Jakarta State
\nAdministrative Court that the 20.5-hectares of disputed land are
\npart of 180 hectares of land owned by the Navy, which it
\nappropriated from illegal squatters in 1992.<\/p>\n
The land appropriation permit for the 20.5 hectares was issued
\nby the government that year, granting the Navy the right to use
\nthe land, the representatives said.<\/p>\n
Soemardjo, a resident, lodged a lawsuit in January at the
\ncourt claiming to own the 20.5 hectares of land. The lawsuit was
\naddressed to the Jakarta governor and head of the North Jakarta
\nBoard of Land Affairs.<\/p>\n
The land in dispute comprises 20.5 hectares located on Jl.
\nPerintis Kemerdekaan in Kelapa Gading, a subdistrict of North
\nJakarta.<\/p>\n
A government team had previously been deployed to investigate
\nand measure the land before the right was granted by the
\ngovernment and the Board of Land Affairs, the government
\nrepresentatives said.<\/p>\n
They added that the Navy first appropriated the 20.5 hectares
\nfrom 130 occupants on March 7, 1960.<\/p>\n
The governor is being sued for having issued the Navy an
\nappropriation permit for the land.<\/p>\n
The North Jakarta Board of Land Affairs is being sued for
\ngranting the Navy a permit to use the land despite Soemardjo's
\nownership of the land.<\/p>\n
In his suit, Soemardjo said that the Navy had forced him to
\nleave the land in June, 1993, by saying that the land was the
\nNavy's property.<\/p>\n
Soemardjo claimed to have purchased the land from four
\ndifferent proprietors.<\/p>\n
Representatives from the Navy, one of the four parties
\ninvolved, said that the Navy had neglected paying property taxes
\non the disputed land due to special circumstances.<\/p>\n
They cited a government regulation which stipulates that plots
\nof land and buildings belonging to the Armed Forces are not taxed
\nuntil further government regulation is issued.<\/p>\n
Appearing as an intervener party, the Navy also refuted an
\naccusation that the buildings under construction on the disputed
\narea are being illegally built.<\/p>\n
