Mustika Ratu tells Martha to back down<\/p>\n
JAKARTA (JP): Publicly listed cosmetic producer PT Mustika
\nRatu has called on its main rival, Martha Tilaar, the owner of PT
\nMartina Berto, to back down in the row over the right to use the
\nname Taman Sari.<\/p>\n
Dini C. Tobing of Lubis, Santosa and Maulana law firm
\nrepresenting Mustika Ratu said the Directorate General of
\nIntellectual and Property Rights ruled in September that the name
\nbelonged to her client.<\/p>\n
Martha Tilaar's lawyer Hotma Sitompoel on Nov. 13 said his
\nclient would not withdraw its claim on the right to use the name
\nbecause its product was in a different classification to that of
\nMustika Ratu's.<\/p>\n
Dini has refuted the claim and has stressed that Mustika Ratu
\nhad used name under trademark since 1999.<\/p>\n
Hotma has proposed that the row over the use of the name be
\nresolved amicably.<\/p>\n
Dini has questioned Martha Tilaar's peace offer.<\/p>\n
\"Martha Tilaar has not withdrawn her application,\" she said.
\n\"Martha Tilaar has never even contacted us,\" she added.<\/p>\n
Mustika Ratu won the first round of the battle when it
\nregistered Taman Sari with the Directorate General of
\nIntellectual and Property Rights before Martha Tilaar applied to
\ndo so.<\/p>\n
Indonesia's cosmetic market is dominated by the two local
\ncompanies, both established and managed by women founders.
