        "content": "<p>Jakarta - The legal counsel for three defendants in the case of the\nmurder of Mohammad Ilham Pradipta, the branch head of a state-owned\nbank, considers the indictment drafted by the Military Prosecutor II-07\nunacceptable.<\/p>\n<p>\u201cI state that the Indictment Letter of Military Prosecutor II-07\nJakarta No.\u00a0Resdak\/49\/K\/III Roman\/2026 dated 6 April 2026, which has\nbeen presented by the Military Prosecutor in the trial on 6 April 2026,\nis null and void by law or, according to the law, the indictment of\nMilitary Prosecutor II-07 Jakarta is unacceptable,\u201d said the defendant\u2019s\ncounsel, Lieutenant Colonel Chk Nugroho Muhammad, during the trial on\nMonday (13\/4\/2026).<\/p>\n<p>Nugroho assessed that the indictment read by the Military Prosecutor\ndoes not contain a careful, clear, and complete description of the facts\nrelated to the charged criminal act.<\/p>\n<p>Additionally, Nugroho stated that the determination of the suspect\nfor Defendant III is not based on at least two valid pieces of\nevidence.<\/p>\n<p>\u201cThere is no alleged criminal act committed, no connection of the\nDefendant to the case, thus the process does not comply with legal\nprocedures,\u201d explained Nugroho.<\/p>\n<p>Previously, the Military Prosecutor\u2019s Office (Otmil) II-07 Jakarta\nindicted Serka Mochamad Nasir, Kopda Feri Herianto, and Serka Franky\nYari in the premeditated murder case related to the death of the\nstate-owned bank branch head, Mohammad Ilham Pradipta, at the Military\nCourt II-08 Jakarta.<\/p>\n<p>Military Prosecutor Major Chk Wasinton Marpaung stated that the\nactions of the defendants fulfil the elements of the criminal offence as\nregulated in Article 340 of the Criminal Code in conjunction with\nArticle 55 paragraph (1) first of the Criminal Code, in conjunction with\nArticle 459 of Law No.\u00a01 of 2023 on the Criminal Code, as well as in\nconjunction with Article 20 letter a of the same law.<\/p>\n<p>\u201cArticle 338 of the Criminal Code jo Article 55 paragraph 1 first of\nthe Criminal Code jo Article 458 paragraph 1 of Law No.\u00a01 of 2023 on the\nCriminal Code jo Article 20 letter d,\u201d stated the Military\nProsecutor.<\/p>\n<p>Not only that, the prosecutor also submitted an alternative\nindictment in the form of deprivation of liberty that resulted in the\nvictim\u2019s death.<\/p>\n<p>Specifically for defendant Nasir, the military prosecutor added an\nindictment related to the act of concealing the death.<\/p>\n<p>\u201cArticle 181 of the Criminal Code jo Article 55 paragraph 1 first of\nthe Criminal Code jo Article 270 of the Republic of Indonesia Law No.\u00a01\nof 2023 on the Criminal Code jo Article 20 letter a of Law No.\u00a01 of 2023\non the Criminal Code,\u201d he revealed.<\/p>",
