Mujahiddin congress calls for Islamic law<\/p>\n
YOGYAKARTA (JP): A three-day Mujahiddin Congress ended here on
\nMonday after recommending that the Criminal Code (KUHP) be
\nreplaced with Syariah Islamic law and the National Commission for
\nHuman Rights (Komnas HAM) be disbanded.<\/p>\n
Chairman of the congress' organizing committee Irfan S. Awwas
\nsaid that the KUHP was a Dutch colonial inheritance and needed to
\nbe discarded because it was against the teachings of all
\nreligions.<\/p>\n
\"Every religion in the world forbids its followers from
\nengaging in illicit sex. Yet the KUHP does not proscribe a
\npunishment to those proven to have taken part in such illegal
\ndeeds if they were done voluntarily or by way of mutual consent,\"
\nIrfan said.<\/p>\n
Komnas HAM, he said, had harmed Muslims. \"Fearing it is
\nbreaching human rights, the commission has done nothing to stop
\nthings which, according to the Islamic world view, are against
\nSyariah law,\" Irfan said, not giving any more detail.<\/p>\n
The 1,500 Muslims attending the congress agreed that Syariah
\nlaw was the only solution to all problems relating to society,
\npolitics and human rights.<\/p>\n
Fifteen of the participants came from Malaysia, Singapore and
\nthe United States. The rest were from Indonesia.<\/p>\n
Demands for the application of Syariah law have been made by
\ncertain Muslim groups in the country since independence.<\/p>\n
The Mujahiddin group also asked that the Jakarta Charter be
\nincluded in the constitution. The charter, formulated by Muslims
\non June 22, 1945, explicitly required Indonesian Muslims to apply
\nand practice Syariah Islam. It was included in the draft version
\nof the 1945 constitution but was dropped from its final version.<\/p>\n
Amendment<\/p>\n
On the first day of the People's Consultative Assembly (MPR)
\nAnnual Session in Jakarta on Monday the application of Syariah
\nIslam was also discussed.<\/p>\n
Some factions from Islamic-based parties at the Assembly urged
\nthat Article 29 of the 1945 Constitution be amended by adding an
\nexplicit requirement that Muslims apply and practice Syariah law.<\/p>\n
The Indonesian Democratic Party of Struggle (PDI-P) and the
\nmilitary factions proposed that the statement 'The state ideology
\nis Pancasila' be added to Article 1 of the 1945 Constitution.<\/p>\n
Article 1 describes the form and sovereignty of country.<\/p>\n
Paragraph 1 of Article 29 says \"The State shall be based upon
\nbelief in the One Supreme God\", and Paragraph 2 says \"The State
\nshall guarantee freedom to every resident (citizen) to adhere to
\nhis respective religion and to perform his religious duties in
\nconformity with that religion and that faith.\"<\/p>\n
The Mujahiddin congress strongly demanded the application of
\nthe Jakarta Charter to the constitution, or the amendment of
\nParagraph 2 of Article 29.<\/p>\n
In a bid to promote Syariah law and to instill leadership
\namong Muslims, the congress established a ahlu hali wal aqdi
\nassembly, a forum supposed to have 36 members.<\/p>\n
Abu Bakar Ba'asyir of Ngruki Pesantren (Islamic boarding
\nschool) in Sukoharjo, Central Java was elected as Amirul
\nMujahiddin (temporary chairman) until the assembly manages to
\nrecruit 36 members.<\/p>\n
Ten Muslim scholars became members of the assembly, including
\nDeliar Noor, Mawardi Noor and Ali Yafie from Jakarta, and Teuku
\nIbrahim Banda from Aceh.<\/p>\n
Abu Bakar Ba'asyir told a media conference after his election
\nthat the government had only two choices. \"Apply Syariah law or
\nwe (Muslims) will die on Allah's way.\"<\/p>\n
When asked if the two choices were meant to legitimatize the
\ntaking up of arms should the government fail to respond to their
\ndemand, Abu Bakar said 'no'.<\/p>\n
\"It's just an expression of our (Muslim) determination to
\nstruggle for the application of Syariah law.\" (swa\/sur)<\/p>",
