        "content": "<p>The Ministry of Manpower is processing complaints about violations of\nreligious holiday allowances (THR) reported by workers. As of 25 March\n2026, 173 cases have been resolved, while 1,461 cases remain under\nhandling.<\/p>\n<p>Manpower Minister Yassierli has requested governors to follow up on\nevery report received through the Ministry of Manpower\u2019s THR Post and\nlabour offices. \u201cI ask the governors to immediately deploy labour\ninspectors to examine every incoming report, whether through the\nMinistry of Manpower\u2019s THR Post or posts at labour offices,\u201d said\nYassierli in an official statement quoted on Sunday, 29 March 2026.<\/p>\n<p>From all reports collected up to 25 March 2026, the Ministry of\nManpower has issued 200 Performance Inspection Reports, 7 Inspection\nNotes I, and 4 recommendations.<\/p>\n<p>Previously, Deputy Minister of Manpower Afriansyah Noor stated that\nbetween 21-25 March 2025, there were 102 new complaints reported by\nworkers. However, THR must be given no later than seven days before the\nholiday.<\/p>\n<p>Since the post opened until Wednesday, 25 March 2025, the total\ncomplaints entered into the system have reached 2,443. In contrast,\nduring Eid 2025 in the same period, the post collected 2,415 complaints.\n\u201cSo this year\u2019s complaints are still considerable,\u201d Afriansyah told\nTempo on Wednesday, 25 March 2026.<\/p>\n<p>According to Afriansyah, the issues with religious holiday allowance\npayments are generally the same year after year. He suspects that if\nlayoffs occur after Eid, THR violation complaints will increase.<\/p>\n<p>Afriansyah said the controversy over allowance payments arises not\nonly from non-compliance but also from company financial problems. Thus,\nsimilar issues will continue to recur. \u201cOur prediction is that THR\ncomplaints or problems will never be fully resolved,\u201d he stated.<\/p>\n<p>The provision of THR is a company obligation that must be paid in\nfull and cannot be instalment. Based on Ministry of Manpower Regulation\nnumber 6 of 2016, companies that delay THR payments will be fined 5\npercent of the total THR that must be paid. This fine does not eliminate\nthe employer\u2019s obligation to still pay the allowance.<\/p>\n<p>A series of sanctions await employers who do not pay THR. Based on\nGovernment Regulation (GR) Number 36 of 2021 on Wages, companies may\nface administrative sanctions such as written reprimands, restrictions\non business activities, temporary suspension of some or all production\nequipment, up to freezing of business activities.<\/p>\n<p>Meanwhile, Chairman of the Manpower Sector of the Indonesian\nEmployers Association (Apindo) Bob Azam stated that the annual THR\npayment controversy stems from two factors. \u201cThe THR issue combines\ncompliance and financial problems (of companies),\u201d he told Tempo on\nWednesday, 25 March 2026.<\/p>\n<p>According to him, THR distribution has become a culture, even in the\ninformal sector which is not strictly monitored by law. Although there\nis an intention to comply, companies sometimes face financial\nconstraints.<\/p>\n<p>In addition, he believes there is a need for effective internal\nbipartite dialogue between employers and employees so that this problem\ndoes not recur. He suspects that such discussions have not been a\npriority so far. \u201cIt seems trivial, but this is the basic foundation of\nhealthy industrial relations,\u201d he said.<\/p>\n<p>While acknowledging the factor of company financial difficulties,\nDeputy Minister of Manpower Afriansyah Noor assured that companies\nfailing to fulfil their THR payment obligations will be dealt with.\n\u201cCompanies that do not comply with the payment exhortation will be given\nadministrative sanctions and fines,\u201d he said.<\/p>",
