        "content": "<p>Rifaldy and associates admit to using names of academic\ninstitutions.<\/p>\n<p>The Ministry of Human Rights (KemenHAM) has denied allegations that\nthe revision of Law No.\u00a039 of 1999 on Human Rights is intended to weaken\nthe independence of the National Human Rights Commission (Komnas HAM).\nThe government argues the regulatory changes are designed to bolster the\nnational HAM institution\u2019s authority.<\/p>\n<p>Rumadi Ahmad, Strategic Advisor for Bureaucratic Reform and\nLegislation Strengthening at KemenHAM, stated that claims the revision\nprocess was non-participatory or aimed at \u201ccrushing\u201d Komnas HAM\u2019s\nindependence are factually unfounded.<\/p>\n<p>\u201cIt is incorrect that the HAM law revision weakens Komnas HAM\u2019s\nindependence. The statement by the Komnas HAM Chairman claiming there is\nan attempt to undermine its independence is without factual basis,\u201d\nRumadi said in a statement on Sunday (31 May).<\/p>\n<p>He explained that since the start of the revision discussions,\nKemenHAM has involved various civil society elements, HAM activists, and\nother national HAM institutions such as the National Commission on\nWomen, the Child Protection Commission (KPAI), and the National\nCommission on Disabilities (KND).<\/p>\n<p>Rumadi also stressed that Komnas HAM was invited to several\ndiscussion forums on the revision. \u201cKomnas HAM Chairman Anis Hidayah\nattended a KemenHAM invitation for discussions on the proposed HAM law\nchanges. Similarly, Komnas HAM experts were also invited,\u201d he said.<\/p>\n<p>He noted that recently, Komnas HAM representatives stopped attending\ndiscussions without clear reason. KemenHAM also denies accusations of\nmanipulated public participation in the revision process. According to\nRumadi, the government understands the importance of meaningful public\nparticipation in law-making.<\/p>\n<p>\u201cKemenHAM fully recognises that drafting the HAM law must involve\nmeaningful public participation,\u201d he said.<\/p>\n<p>Currently, Rumadi added, KemenHAM is conducting public consultation\nforums across regions and universities, and has opened channels for\npublic feedback via the ministry\u2019s official website.<\/p>\n<p>Regarding concerns that requiring Komnas HAM\u2019s recommendations to be\nsubmitted to KemenHAM would reduce the commission\u2019s independence, Rumadi\nargued the mechanism aims to strengthen the implementation of HAM\nrecommendations within government.<\/p>\n<p>\u201cThat is precisely to ensure Komnas HAM\u2019s recommendations to\nministries, institutions, and local governments are implemented by the\ngovernment,\u201d he said.<\/p>\n<p>Rumadi further stated that in the draft revision of the HAM law,\nKomnas HAM\u2019s position is actually strengthened. This includes\nreinforcing the binding nature of Komnas HAM\u2019s recommendations and\nexpanding its authority from preliminary to formal investigation.<\/p>\n<p>\u201cClaims that these changes aim to weaken Komnas HAM are entirely\nfalse. The changes actually strengthen Komnas HAM,\u201d he said.<\/p>\n<p>Furthermore, Rumadi mentioned academic input during public\nconsultation forums, including proposals to merge national HAM\ninstitutions like Komnas HAM, KPAI, KND, and the National Commission on\nWomen.<\/p>\n<p>However, he said, the government\u2019s draft keeps these institutions\nseparate, adding coordination mechanisms for overlapping cases.<\/p>\n<p>\u201cOther problematic aspects, KemenHAM, responsible for the law\nrevision, remains open to suggestions from various parties, including\nKomnas HAM,\u201d he concluded.<\/p>\n<p>Human Rights Ministry Technical Expert Ifdhal Kasim stated that\nprovisions on the right to be forgotten are a key point in the current\ngovernment-drafted HAM law revision.<\/p>\n<p>The right to be forgotten is already regulated under Article 26\nParagraph 3 of the Electronic Information and Transactions Law (UU\nITE).<\/p>\n<p>Human Rights Ministry Special Staff Thomas Harming Suwarta\nhighlighted social media dynamics and the planned HAM bill including the\nright to be forgotten.<\/p>\n<p>The inclusion of the Right to be Forgotten in the HAM bill has drawn\nattention. Kaka Suminta warned of risks in deleting digital footprints\nof public officials and transparency issues.<\/p>\n<p>Transparency International Indonesia noted that corruption has\nstripped citizens\u2019 basic rights.<\/p>\n<p>Komnas HAM views the HAM law revision as the peak of systematic\nefforts to weaken and delegitimise the commission.<\/p>\n<p>Komnas HAM urges revision of Law No.\u00a021\/2007 on Trafficking in\nPersons (TPPO) due to the rise of online scams and digital-based human\ntrafficking modes.<\/p>\n<p>Human Rights Minister Natalius Pigai stressed that escalating\nconflicts and violence in Papua require comprehensive solutions through\ndialogue, human rights approaches, and multi-institutional\ninvolvement.<\/p>\n<p>Such concerns are based on the commission\u2019s experience handling\nvarious complaints over time.<\/p>\n<p>The ministry has taken a series of steps since mid-March to\ninvestigate the case.<\/p>",
