Military police declare Agus a suspect<\/p>\n
JAKARTA (JP): Just one day after a district court heard the
\ntestimony of Army Second Lt. Agus Isrok as a witness in a
\ncivilian drug case, military police prosecutors completed their
\ndossiers on Agus and have declared him a suspect.<\/p>\n
\"We have resubmitted the dossiers of Agus Isrok to the Jakarta
\nMilitary Prosecutor's Office. Agus has been declared a suspect,\"
\nNational Military Police chief Maj. Gen. Djasrie Marin
\nannounced on Tuesday.<\/p>\n
The prosecutor's office sent the initial version of the
\ndossiers back to the National Military Police Headquarters last
\nmonth, after the office deemed the dossiers incomplete.<\/p>\n
Djasrie said the suspect, who is an active member of the
\nArmy's Special Force (Kopassus), is currently being detained at
\nthe Kopassus headquarters in Cijantung, East Jakarta.<\/p>\n
\"Agus will be tried at a military court because he is a
\nmilitary member,\" he said.<\/p>\n
The two-star general said Agus was suspected to have been
\ninvolved in drug abuse and possession last August. Agus was
\narrested by the West Jakarta Police along with Donny Hendrian, in
\nroom 408 of Hotel Travel in West Jakarta on Aug. 8.<\/p>\n
The police reportedly seized items in the room, including 1.6
\nkilograms of shabu-shabu (crystal methamphetamine), 6,218 ecstasy
\npills, 27.9 grams of heroin and 25 sachets of Valium pills.<\/p>\n
Both Agus and Donny, who is currently being tried at the West
\nJakarta District Court, have denied possessing the drugs.<\/p>\n
Agus appeared on Monday at Donny's trial hearing at the West
\nJakarta District Court as a witness, only one day after his
\nfather, former Army chief Gen. Subagyo Hadisiswoyo, vowed that he
\nwould not interfere in the investigation and prosecution process
\nof his eldest son.<\/p>\n
Djasrie denied there had been any pressure from Gen. Subagyo
\nin regard to the prosecution of the officer, saying that the
\ngeneral had only asked him about the progress of his son's
\nprosecution.<\/p>\n
Gen. Subagyo, who is still an active military officer, is
\ncurrently a military advisor to President Abdurrahman Wahid.<\/p>\n
Asked why it took the military police headquarters five months
\nto complete the dossiers, Djasrie said the headquarters had to
\ncarefully compile the dossiers, including revise some of the
\nwitnesses' testimonies.<\/p>\n
Col. A.M. Ambong, head of the Jakarta Military Prosecutor's
\nOffice, said last week that the office sent the dossiers back to
\nthe military police headquarters after the headquarters had
\nfailed to describe in detail Agus' activities right before he was
\narrested by the police in the hotel room.<\/p>\n
Col. Hendardji, the director of investigation at the
\nheadquarters, said last week that the military police's dossiers
\nlisted the suspect as Agus Isrok, not his alias Deky Setiawan,
\nwhich had been used in the police report and the prosecutor's
\nindictment.<\/p>\n

Noted lawyer Denny Kailimang suggested that the indictment
\nshould be revised because listing a witness under a fictitious
\nname would influence the verdict.<\/p>\n
\"The indictment should be revised, since the judge will always
\nbase his verdict on facts, such as witnesses' testimonies in the
\nhearings and also facts stipulated in the indictment,\" he told
\nThe Jakarta Post on Tuesday.<\/p>\n
He said a revised police report could be sent back to the
\nprosecutor, as a legal basis for making a new indictment. \"Then,
\nbased on the indictment, the court could start a new hearing of
\nthe case, and scrap the old process.\"<\/p>\n
Kailimang, who is also one of the lawyers of former president
\nSoeharto, lashed out at the police and the prosecutor over the
\ncase, saying that they had acted unprofessionally.<\/p>\n
\"Before receiving the report from the police, the prosecutor
\nshould have verified whether it was complete, including the
\nidentity of the witness,\" he said.<\/p>\n
He conceded that the unprofessional manner of the legal
\ncommunity often ended in unfair verdicts.<\/p>\n
\"Some defendants are cleared of all charges because of such
\nunprofessional habits. They may have brought losses to the state
