Jakarta's Metro Jaya Police are probing a complaint of alleged medical malpractice at a hospital in South Jakarta, where a patient received treatment deemed inappropriate by a second medical opinion. The case involves discrepancies in diagnoses, such as the number of heart stents recommended, leading the patient to file a report under Indonesia's Health Law and Criminal Code. This investigation highlights ongoing concerns over accountability in the healthcare sector and potential criminal liability for medical professionals.

Jakarta (ANTARA) - Metro Jaya Police are delving into a report of
alleged malpractice at a hospital in the South Jakarta area against one
of its patients.

The Head of Public Relations for Metro Jaya Police, Senior
Commissioner Budi Hermanto, told reporters in Jakarta on Wednesday that
the investigation concerns an analysis by a doctor that does not justify
the hospital’s medical actions towards the victim (patient).

“This is still under investigation regarding an analysis from a
doctor about a patient’s illness. However, the individual sought a
second opinion from another doctor. It turns out that the comparison
between the first doctor and the second doctor does not match,” said
Budi.

He gave an example of this differing medical viewpoint in the case of
heart stent placement. “For instance, the placement of a heart stent
with the first doctor is one, but with another doctor it is more than
one, so there is no benefit. Or it cannot be used with just one,” Budi
explained.

Based on this second opinion, the victim felt aggrieved and
subsequently reported it to Metro Jaya Police. To date, the police are
continuing their investigation, including examinations of the victim and
evidence.

“This is still under investigation, and later the reporter along with
the evidence will be reviewed,” Budi emphasised.

Previously, Metro Jaya Police received a report against a hospital
with the initials S, suspected of committing malpractice against a
patient.

The report was filed by the victim’s legal representative regarding
alleged criminal acts in the health sector as referred to in Article 440
paragraph (1) of Law Number 17 of 2023 on Health in conjunction with
Article 474 paragraph (2) of the Criminal Code.

“The report originated from the patient who felt that the medical
treatment received did not match the medical indications,” he said.
",
