        "content": "<p>JAKARTA \u2014 The Marriage Law Number 1 of 1974, specifically regarding a\nhusband\u2019s obligations under Article 34, Paragraph 1, is being viewed as\na loophole for material exploitation within the household. This was\nstated by the petitioner of case number 159\/PUU-XXIV\/2026 in the grounds\nfor the judicial review of the Marriage Law at the Constitutional Court\n(MK).<\/p>\n<p>\u201cThat the unilateral burden of obligation becomes a loophole for\nmaterial exploitation within the household,\u201d the lawsuit stated, as\nreported on Monday (18\/5\/2026).<\/p>\n<p>According to the petitioner, this constitutes a violation of the\nconstitutional rights under Article 28G, Paragraph 1 of the 1945\nConstitution, which states: Every person has the right to the protection\nof their personal self, family, honour, dignity, and property under\ntheir control, as well as the right to security and protection from\nthreats of fear to do or not do something that constitutes a human\nright.<\/p>\n<p>\u201cThis unbalanced norm is frequently exploited and used as an\ninstrument of justification for wives to drain the husband\u2019s material\nassets with bad faith,\u201d the petitioner said.<\/p>\n<p>Husbands who are legally compelled by the state to bear all costs are\ndeemed vulnerable to extortion, the neglect of their human rights, and\nthe arbitrary seizure of their property.<\/p>\n<p>Consequently, in the petition\u2019s prayer, the petitioner requests that\nthe Constitutional Court amend the aforementioned articles to state:\n\u201cHusbands and wives have a mutual and reciprocal obligation to protect\nand respect one another, to provide all the necessities of household\nlife, and to manage household affairs proportionally in order to realise\na marriage that is a partnership of equals based on sincere love.\u201d<\/p>",
