        "content": "<p>Man could be jailed for cybercrime<\/p>\n<p>Muninggar Sri Saraswati, The Jakarta Post, Jakarta<\/p>\n<p>A former manager of local cosmetic giant PT Martina Berto,<br>\ncharged with illegally registering the domain name<br>\nMustikaRatu.com after the company&apos;s main competitor PT Mustika<br>\nRatu, should be jailed for four months, the prosecution have<br>\ndemanded.<\/p>\n<p>Defendant Tjandra Sugiono, 32, should also pay a fine of Rp 30<br>\nmillion, prosecutor Y.N. Eddy told the Central Jakarta District<br>\nCourt on Thursday.<\/p>\n<p>The case is the first cybercrime ever tried in the country.<\/p>\n<p>&quot;The fact that the defendant had registered a popular domain<br>\nname without asking permission from the owner indicates an unfair<br>\nbusiness competition,&quot; Eddy told the hearing presided over by<br>\njudge Chasiany R. Tandjung.<\/p>\n<p>The defendant was charged with violating Article 382 of the<br>\nCriminal Code on fraudulent competition, and Article 48 of the<br>\nAntimonopoly Law No. 5\/1999 which requires a business party not<br>\nban its competitor&apos;s consumers from making business contact with<br>\nthe rival.<\/p>\n<p>According to the prosecutor, Tjandra registered domain name<br>\nMustikaRatu.com in October 1999. PT Martina Berto was identified<br>\nas the registrant while Tjandra acted as the administrative and<br>\nbilling contact.<\/p>\n<p>The MustikaRatu.com website would lead visitors to the Belia-<br>\nOnline.com website displaying Belia cosmetics, a product of PT<br>\nMartina for teenagers, Eddy said.<\/p>\n<p>Tjandra admitted that he registered the domain name for<br>\nfinancial benefit, Eddy said, but he had never offered PT Mustika<br>\nrights to the domain name, until he resigned from PT Martina in<br>\nJune 2000.<\/p>\n<p>It is common among Internet users that domain names to be sold<br>\nto other interested parties for financial benefit, he said.<\/p>\n<p>Eddy said several overseas business partners of PT Mustika,<br>\nincluding Abdul Rahman Zohaifi and Bros Co in Arab Saudi and<br>\nMalaysian company Medical Supplies, became confused as when they<br>\nclicked the domain name, they found Belia products, instead of PT<br>\nMustika products.<\/p>\n<p>&quot;Because of what the defendant did, PT Mustika lost more than<br>\nRp 10 billion following a significant decrease in business<br>\ntransactions with its business partners,&quot; he said.<\/p>\n<p>Tjandra had withdrawn the domain name in Sept. 2000, after<br>\nMartha Tilaar, the owner of PT Martina, ordered him to do so.<\/p>",
