Man could be jailed for cybercrime<\/p>\n

A former manager of local cosmetic giant PT Martina Berto,
\ncharged with illegally registering the domain name
\nMustikaRatu.com after the company's main competitor PT Mustika
\nRatu, should be jailed for four months, the prosecution have
\ndemanded.<\/p>\n
Defendant Tjandra Sugiono, 32, should also pay a fine of Rp 30
\nmillion, prosecutor Y.N. Eddy told the Central Jakarta District
\nCourt on Thursday.<\/p>\n
The case is the first cybercrime ever tried in the country.<\/p>\n
"The fact that the defendant had registered a popular domain
\nname without asking permission from the owner indicates an unfair
\nbusiness competition," Eddy told the hearing presided over by
\njudge Chasiany R. Tandjung.<\/p>\n
The defendant was charged with violating Article 382 of the
\nCriminal Code on fraudulent competition, and Article 48 of the
\nAntimonopoly Law No. 5\/1999 which requires a business party not
\nban its competitor's consumers from making business contact with
\nthe rival.<\/p>\n
According to the prosecutor, Tjandra registered domain name
\nMustikaRatu.com in October 1999. PT Martina Berto was identified
\nas the registrant while Tjandra acted as the administrative and
\nbilling contact.<\/p>\n
The MustikaRatu.com website would lead visitors to the Belia-
\nOnline.com website displaying Belia cosmetics, a product of PT
\nMartina for teenagers, Eddy said.<\/p>\n
Tjandra admitted that he registered the domain name for
\nfinancial benefit, Eddy said, but he had never offered PT Mustika
\nrights to the domain name, until he resigned from PT Martina in
\nJune 2000.<\/p>\n
It is common among Internet users that domain names to be sold
\nto other interested parties for financial benefit, he said.<\/p>\n
Eddy said several overseas business partners of PT Mustika,
\nincluding Abdul Rahman Zohaifi and Bros Co in Arab Saudi and
\nMalaysian company Medical Supplies, became confused as when they
\nclicked the domain name, they found Belia products, instead of PT
\nMustika products.<\/p>\n
"Because of what the defendant did, PT Mustika lost more than
\nRp 10 billion following a significant decrease in business
\ntransactions with its business partners," he said.<\/p>\n
Tjandra had withdrawn the domain name in Sept. 2000, after
\nMartha Tilaar, the owner of PT Martina, ordered him to do so.<\/p>",
