The Jakarta Central District Court\u2019s Corruption Court has sentenced\nHendarto, Director and beneficial owner of Bara Jaya Utama (BJU) Group,\nto eight years in prison. Hendarto was found legally and convincingly\nguilty of committing corruption in connection with the provision of\ncredit facilities by the Indonesian Export Financing Agency (LPEI).<\/p>\n
The verdict was read by Chief Judge Brelly Yuniar Dien on Monday. In\naddition to the prison sentence, the defendant was ordered to pay a fine\nof Rp500 million, with a subsidiary of 140 days\u2019 confinement.<\/p>\n
\u201cThe defendant Hendarto has been legally and convincingly proven to\nhave committed corruption jointly and continuously,\u201d Judge Brelly stated\nduring the trial.<\/p>\n
In its considerations, the panel of judges noted that Hendarto had\nenriched himself by Rp1.06 trillion and 49.88 million US dollars. This\namount also constitutes the state financial loss in the case.\nConsequently, the judges imposed an additional penalty of a replacement\npayment equal to that sum, with a threat of an additional seven years\u2019\nimprisonment if not paid.<\/p>\n
The court revealed that the corruption was carried out together with\nseveral former LPEI officials, including former Executive Director\nNgalim Sawega and other former managing directors. The modus operandi\ninvolved using LPEI financing facilities for plantation businesses\nlocated in protected forest and conservation areas.<\/p>\n
Aggravating factors for the sentence included the defendant\u2019s use of\npart of the corruption proceeds for gambling and purchasing luxury\ngoods. Mitigating factors were the defendant\u2019s ill health and his\ncooperative attitude during the trial.<\/p>\n
The eight-year prison sentence matched the demand of the public\nprosecutor.
