        "content": "<p>Jakarta \u2013 The chairman of the National Collective Management\nInstitution (LMKN) Pencipta, Andi Mulhanan Tombolotutu, has urged listed\ncompanies (Tbk) to implement compliance and consistently fulfil their\nobligations to pay royalties for music and songs played in their retail\noutlets.<\/p>\n<p>According to Mulhanan, music broadcast in public spaces through\ntelevision, radio, retail outlets, restaurants, caf\u00e9s, and hotels is\nclassified as commercial use. Consequently, every business operator is\nobligated to respect the economic rights of creators through the royalty\npayment mechanism managed by LMKN.<\/p>\n<p>\u201cMany listed companies (Tbk) broadcast music in public spaces but\nhave yet to fulfil their royalty payment obligations,\u201d Mulhanan stated\nin an official statement received on Wednesday.<\/p>\n<p>Mulhanan added that the modern retail sector, such as fast-food\nrestaurants and broadcasting companies (television), represents the\nlargest users of music in public spaces. Music is played almost\nthroughout operating hours to create atmosphere, reinforce brand\nidentity, and enhance customer comfort.<\/p>\n<p>However, ironically, not all business operators fulfil this\nobligation.<\/p>\n<p>Mulhanan believes that listed companies with stricter reporting\nstandards and governance compared to private companies means that lack\nof awareness about regulations becomes less relevant as an excuse.<\/p>\n<p>He added that the issue of music royalties in public spaces is not\nmerely a legal matter, but also a question of awareness. Many business\noperators still view music merely as a complementary facility, despite\nits having genuine economic value.<\/p>\n<p>Under Indonesia\u2019s copyright system, LMKN has a state mandate to\ncollect and distribute royalties from the commercial use of songs and\nmusic. The collected funds are then channelled to creators and rights\nholders through collective management institutions.<\/p>\n<p>Mulhanan assured that LMKN continues to conduct education and adopt a\npersuasive approach with business operators. However, if necessary,\nlegal enforcement measures will still be pursued.<\/p>\n<p>Moving forward, LMKN hopes that more companies will make royalty\ncompliance part of their commitment to the national creative\nindustry.<\/p>\n<p>\u201cOur approach continues to prioritise education. But legal compliance\nis mandatory,\u201d he said.<\/p>",
